Sorry to hear that you are waiting this long. I know how hard it is for you especially you have a kid. You can file DCF I guess. But in order to file DCF your husband need the 13a philippine visa stamp in his passport. Its one of the requirement on filing via DCF. And getting 13a visa will take 2 months from the date of application in the philippine immigration to approval. Excluding the preparation of all other documents required.

So just hang in there; your approval might come soon. Doing things in other route might not be a good choice. Aside from the chance that your pending I-130 might affect the new process.

our american friend did not file any of that from Philippine immigration, and still his wife got approved.. so I dont believe that we need that from here.. and also his wife got approved within 30 days... so as what i said on my previews reply i see a big difference because my hubby lives here longer than our friend and i dont see any reason why they will not approve me since they approve our american friend's wife.. he doesnt have any proof that he has a strong evidence that he resides here except for being here for only 2 years.. thats all..

I wouldn't chance messing up the first application. It will come up soon. The Vermont Service Center is really very far behind the other centers. I noticed our I-129F took 2-3 months longer than people who got processed through California/Texas. You are going to kick yourself if you move it to DCF and there is a problem with it, and your original I-130 gets delayed even further (if not cancelled)!

It is in process and is probably just sitting in a stack somewhere waiting for someone to get to it. For all you know it could be tomorrow!
