Okay so! First off thank you for reading this!

So basically I'm form the US, I've just got a job 2 months ago and its going wonderfully, the only problem is this is my first job and I've never had an income before to pay taxes and thus I don't have any tax returns.

He is from the UK, hes been self employed for about a year now, hes a programer and sells phone apps which means his income will continue when he comes over here without even working, his income has been great this year but so far we only have last years tax returns for him which doesn't show how much hes making now and of course since hes self employed his income is subject to change but has been steady.

Other factors to my main question: We don't have a co-sponsor and won't be able to get one. I understand that even though I've never filed taxes I'll have to submit a statement to AOS as to why (or something along those lines). I've read that his income CAN be added to mine to make the poverty guidelines.

So my question:

How do both he and I go about proving our income so that we can meet the poverty guidelines? Also does he need to fill out his own I-864? How does/would this work?

I really REALLY appreciate all and any help! This has been a big worry on both of our mines and any help would most defiantly ease that.

Basically, tax return papers are to proof that you're employed, and can support the spouse you're bringing over so that when he/she arrives, you guys won't be on public assistance or become homeless. Income just need to meet poverty level from the state you live in. If you don't have those, send a letter explaining your situation, and show/proof how much savings you guys have that ya'll won't starve. They will want to know how much you have in your savings account, profits, mortgage, etc... Good luck! :)

Just follow the instructions exactly in the 864, and post back if you run into a specific problem.

He doesnt fill out his own, the instructions are very clear on that.

For you, the US taxpayer, if you didnt file tax returns the last 3 years, you need to attach a statement explaining why you were exempt from filing.

For your current income, you need to attach proof of it, like your current paystubs. If you get a letter from your current employer stating your position, how long youve been employed, (even your future potential at the company would be an added benefit but not required).

For your husbands income- He needs proof of his income as well. You say you only have last years tax info. Is that because the business started last year? If so thats fine, if not I would try to get atleast the last 3 years of records for it. For the current year he should have a current profit/loss statement. If he doesnt have one he needs to make one up ASAP. For businesses, typically current year statements are broken down monthly. It should show all the profits take in for the month and all the expenses for the month. (you can probably find a template online)

Theres also places on the 864 where you can add assets (if you have any) to supplement you income.

Just make sure you follow the instructions carefully (not counting anyone twice) If it adds up, you have enough, if it doesnt, you need a co-sponsor.
