Hey everyone, I had a few questions and the search engine here is a lil funky, so I was hoping to just ask for some help.

I am sitting in Newark Airport waiting for my flight back to see my Fiancee and get back to work on monday. We were sad because she was denied the 30 day tourist visa, as I have been home for this past month.

We plan on getting married legally in nov/dec and the ceremony is on 3/31/07. Now what we want to do is this.

We only want to return to the US for 2-3 months in may-aug. She will begin to teach again in Sept and I will be starting my MBA here as well. So trying to move perm. to the US is out for the next 2-3 years.

What is the best Idea to bring my soon to be wife to America for a nice vacation?

Well, if she was denied a tourist visa, you are probably going to have to apply for a K-1 visa for her, to come to this county as your fiance. However, that will probably take a while, so you might have to postpone your vacation. Or, if you are going to marry in Thailand, then you'll have to file for another visa, to bring your spouse to the US. But that'll probably take a while as well. I'm not the best person to give you advice on those visas because I didn't go through this process, but you can visit the USCIS website, where you'll find information regarding how to bring your fiance/spouse to this country. http://www.uscis.gov/portal/site/uscis

07/16/2006 - We got married in Reno, Nevada.

USCIS:

08/13/2006 - Filed for AOS, AP, EAD - they were VERY carefully packaged with a detailed cover sheet on top of each of the forms, just as VJ's instructions recommend. It was A LOT of work, but it did pay off! (we firmly believe this is what sped up our process big time)

08/31/2006 - Biometrics appointment

09/09/2006 - Received my AOS appointment date!

10/26/2006 - EAD touched and AP APPROVED!

10/27/2006 - AOS appointment at 7:30 AM! APPROVED IN EXACTLY 70 DAYS!!!

11/01/2006 - EAD approved

11/02/2006 - Email notification - greencard will be mailed as soon as it is ready! YAY again!

11/02/2006 - Welcome to the United States of America letter in the mail! Almost there! =)

11/06/2006 - EAD card and White card (a.k.a. greencard) arrive in the mail!

Journey Total Duration: 80 days

Filed for removal of conditions on 07-28-2008 and had them removed on 09-10-2008

Thanks, the real problem is that I have read that she has to stay in the US for a set amount of time per year. Which we can't do due to work/school. Blah

I have a gov. and sen. office working on some stuff for me, thank God for high powered friends haha. But I don't count on it all.

Does Thailand allow for DCF? It can be the quickest but not all consulates do it and there may be residency requirements which you may have already satisfied. Your timeline need is fairly aggressive and it is possible that none of the marriage based visas will be processed quickly enough for you. Then on top of that there are certain requirements that need to be fulfilled and being out of the country for 2-3 years maybe problematic. I hope others will fill in the holes....

Don't count on much from them at this stage as they really cannot do anything but make inquiries.....

I have to check on the DCF, but We can get home for 3-4 months a year.

But now I gotta get ready to board my flight, I will be gone until friday, I will get more info then. Thanks again everyone!

I'm surprised that your fiancee was refused a B2 visa given your circumstances. Did you play-up your situation in Thailand, the fact that you are living and working there?

And just out of curiosity, did she apply for her visa in Chiangmai or in Bangkok? I've heard it said that Bangkok can be 'easier'. I've no idea if it's true or not, and my natural inclination is to doubt it, but my in-laws who live in Lamphun applied for their B2 visas in Bangkok because they were told that.
