Hi,

I was recently laid off my job (last pay stub was for October 4th) and I am not 100% if my previous employer has terminated my h1b visa yet.

My husband who is a US Citizen is sponsoring my greencard, and we are working on the paperwork together to file. At the moment we do not plan on hiring an attorney.

Since my status is unknown, I am unsure of what to mention in my i-485 (as I have to fill in my current USCIS status, non immigrant visa number etc).

I never left the country while working at my previous job, so I do not have a H1b visa stamp in my passport- I am not sure what my nonimmigrant visa number is or he consulate of where visa was issued.

I plan on filing the I-765 along with my I-485 so I could start working as soon as possible.

Should I hire an attorney to be sure of my status? I am getting very worried about my status since I don't want to be deported/stay illegally.

If I could get some advice i would deeply appreciate it, thank you.

I was in a similar situation and I just put "H-1B" for my status. I did have the visa stamp so I used that visa number. If you don't have one you can probably put "n/a", with a note that you changed status to H-1B without getting a visa. You will include a photocopy of your I-94 and relevant passport pages, so they can probably figure it out.
