CR1 permenant visa without restrictions?

I have been told by various people and just wanted to confirm that in some cases if the visa process takes longer than 1 yr the visa is issued without restrictions rather than a 2yr. In my case it will be a year in feb and I was just wondering if this was true. Thanks for any input.

If, on the date of approval, you have been married for at least two years then you will receive an IR-1 visa which will trigger an unconditional 10 year green card upon entry to the US.

If, on the date of approval, you have been been married for less than two years, you will receive a conditional CR-1 visa which will trigger a conditional 2 year green card that you will have to file to remove conditions from in the normal way.

Not true.

Less than 2 years of marriage, then CR-1 and a conditional green card.

More than 2 years if marriage, then IR-1 and 10 years green card.

How long it takes to process your case is irrelevant.

Damn I should have gotten married sooner.. Lived in DR for 9 yrs and have been with my wife for 6.. Never got married since never considered bringing my family to the states but situation is hectic over there and had to come to US all for the family.. Now I'm definitely going to get hit with that $590 for i751 since we just got married this past feb.. Thanks for the prompt response guys and clearing that up for me.

Since I also submitted i130s for my two step daughters will I have to pay 3 seperate i751 fees or is it like AOS fee where only mother's fee is paid?

You will have to file (and pay) to remove conditions on all three green cards.

The above is mostly correct. I would add that even if a CR1 visa is issued, if the US entry occurs after two years of marriage, the "status" is IR1, resulting in the 10 year card. For example, you could be married 20 months at visa issue, then wait until after the second wedding anniversary to enter the USA. This would entitle the immigrant to IR1 (unconditional) status.
