Just had interview...good and bad news

Timeline

had my interview on monday in Kingston JA....and well we were approved pending a co-sponser or wait to file my 06 tax returns...well my parents were VERY nice and offerd to be the co-sponser...

here are my questions....the embassy asked them to file out a 1-864( i know you use it for the AOS but that is what she said and circled on the blue form)

my parents have both just retired from teaching...i know there 05 tax return was very high so they are well over poverty....do they still need to list there assets?? i really don't see why...there pension is over poverty as well...

as far as listing who they are "covering" it is them plus my brother...and my fiance correct??

i think that is it for the questions for today...

This a peculiar request indeed. Can you get full clarification on the form required? You certainly do not want your parents to carry that "binding" responsibility, particularly if this is not the correct form. I would call and clarify that.

Either way, if the base income is adequate, asset information is not required.

I would not second guess the 221g and send something else, rather, I would call and get clarification. Conventional wisdom suggests that no Embassy requires this form (I-864). Seek clarification first, before taking action.

SEPT 29, 2006 - NOA 2 RECEIVED (APPROVED)

SEPT 2006 - WAITING FOR NEXT STEP

OCT 24, 2006- STILL WAITING.............

NOV 1, 2006 - SEAN RECEIVED PACKET #3 (THANK GOD FOR MAIL...EVEN SNAIL MAIL)

NOV 15 2006- PREPARING TO TURN IN DS230 IN KINGSTON

JAN 18, 2007 TURNED IN DS230

TOLD TO EXPECT MAIL IN MARCH.

FEB 20, 2007 RECEIVED MAIL OF

MARCH 27,2007 INTERVIEW DATE

APR 27, 2007 BRING IN AFFIDAVIT OF SUPPORT

(PRAY THAT HE IS APPROVED)

HE WAS GIVEN INCORRECT DATE!!!!!

MAY 15, 2007 HOPEFULLY THIS IS FINAL APPROVAL

WE HAVE BEEN APPROVED

JUNE 17 2007 FINALLY RECEIVED VISA

AUGUST 3, 2007 FLEW INTO JFK NY

AINT LONG AS IT HAS BEEN.....

STILL SAVING MONEY UP TO FILE AOS.

what happend with me was my 05 tax return was under poverty line...and that is what she based it on the 221g form....i was told and thought that because i have been working for over ayear and i am making more then enough to support us that everything woul be fine...so in my opinion if you made over poverty on 05 you should be fine...but just incase yes i would have your mother fill out the co-sponser form it would be another i-134 form...and before the interview incase they ask for it...

We are required to fill out the I-864 for our interview in Paris. I know that this is a new requirement there because some other VJers used the other form.

Some countries request the I-864 for K-1 filers. If the consulate specifically said to submit it, then don't second guess them. Your parents 2005 taxes should suffice. My mother retired from teaching and submitted her taxes from the prior year and it was fine. Best wishes.

This is good to know because in other places and with other people on VJ the consulate has looked only at the current financial situation of the USC sponsor and has approved a visa based on the current situation. In your case it looks like that was not the case. Thanks for sharing! I'm definitely going in with a co-sponsor, then. (I was a Peace Corps volunteer until the middle of last year and made no money, but this year make enough money, but haven't filed 2006 taxes yet.)

i would do that!!! you neve know!!! my lawyer told me i was fine because of other cases with his client so i went there thinking we were going to be great and get this...no such deal!! the good thing was that we still had the interview and i guess we were "apporved" pending the co-sponser or i could wait to file my 06 taxes...but i am not a patient person so i went with the 1st..

:unsure: What? IF one is using assets as proof, I'd agree. Otherwise, it's not pertinent. Proof of salary(W-2's, employment letter, taxes, etc.) alone is valid.

No, you do not. You show whatever you want to show.

There are consequenses if what one wants to show is insufficient, consequences that may change one's mind and induce one to show more than one originally wanted to show, but one is under no obligation to show anything and everything.
