Hi, I have been together with my boyfriend who is a US citizen for 2 years (I was born and raised in Taiwan). We met in the States when I worked there on a sponsored working visa (L1). Then when he got a job opportunity aboard, I quitted my job and followed him. I was doing my master degree. However, before I finished my degree, he had to move back to the US due to an unexpected issue. We have been apart for about a year and finally decided to get married few days ago (which was not planned). But the problem is, I am in the states on my tourist visa now and his divorce has JUST finalized (They have been separated for 11 years and filed tax as single. He and his ex thought the divorce was official and did not know the paperwork was not filed properly), will there any problems for us to apply for a spouse visa? What is the best option for us to do and not being apart again...? Your suggestion would be extremely appreciated.

You should be fine in adjusting status in USA even if you overstay your visa. Your boyfriend is

an american citizen so you would be an immediate relative immigrating, meaning there will be always a

visa number available for you. Though not recommended you could stay here after you i-94 expires and

solve the whole immigration process inside. You should contact an experienced lawyer that could help you out.

A visa is to enter the country. As you are already in the US, you don't need to switch to another visa, but simply to adjust your status.

You can file by yourself, it's not that complicated and will save you some money. Most of the people on VJ did their paperwork by themselves, with the help of each others and the Guides on VJ (checklist, explanations, etc...).
