My I-130 was approved for my spouse today. I want to use my Father as a sponsor. I live with Him and my Mother and 4 other siblings, we are all over 18 except for one of us. My Father makes $80 000/year. He has bad credit. My Brother who lives with us makes $60 000/year and is single. Am I able to use my Father as a sponsor? How about my Brother. He makes $60 000/ year but only for the last 2 years, but he has good credit. Do I have to get a letter of employment and tax transcripts from my sponsor? Is that enough or do they require more? Please advise me.

I heard that if your income alone reach the poverty guideline for a household including u, ur wife, and ur dependent (if u have any), u dont need co-sponsor.

Absolutely if you can reach the requirement yourself you don't need a Co.

I'm going to assume he knows he doesn't qualify though.

I don't know how credit affects the AoS process, but I'm hoping it doesn't because I don't have very good credit.

I don't think your father or brother have to show support for your ENTIRE household if they are not dependents.

IE: Your dad would not include your brother in the list of people against him on household size because your brother is an adult and support himself. He would, however, need to show support for the child under 18.

Can someone tell me if I'm correct in assuming this?

I am not qualified to be a sponsor. I am in my last year of school and barely working.

First, you should research if your country accepts co-sponsor,

Your brother can be your sponsor if his CURRENT income reach the poverty guideline for him, your fiancee, his other dependents such as kids. If not,

You should find a full time job. Ask for employment letter. and keep your pay stubs.

Which still won't guarantee an approval because they want to see your most recent year's tax filing and also usually like 2 more years on top of that.

Based on what you wrote, if your brother is willing, he is the better choice for a joint sponsor, if you don't qualify on your own. Provide an I-864 from you and one from your brother. Don't use an I-864a. That's for combining income with a household member. Your brother doesn't need to combine income.

I just started a part time job last week, it doesn't qualify me, but I just wanted to make sure that my Brother and I both fill out the i864? So he doesn't have to fill out the i864a?

That's what I said, yes. The I-864a is used when combining income. If your brother qualifies on his own, I-864, not I-864a. Believe it.

I just completed both I-864s and waiting on his letter of employment, tax transcripts and pay stubs. Your the man Pushbrk.
