I'm a little overwhelmed with information and would like the quickest course for immigration for my soon to be wife from Russia. She already has a tourist visa to travel to the U.S. she has been here 4 times and I have been to Russia 4 times and we will be married in December here in the U.S., she will return to Russia in late December and then I will file for her to become a citizen. I want to eliminate any unnecessary steps and expedite this process as much as possible for a ir1-cr1 since she doesn't need a visa. I hope she can still visit me every couple of months on her tourist visa. Any feedback is greatly appreciated.

She has no basis to file for citizenship; you meant file for a CR-1 immigrant visa. Be careful how you use these terms, as a false claim of US citizenship results in a lifetime bar from the US that is not waiverable.

The fact that she has a visitor's visa already will make no difference, she will need an immigrant visa to enter and live in the US. Upon entry on an immigrant visa she will automatically receive a green card within 30 - 60 days.

Timeline

You are not getting her citizenship at this moment. You'll file the I130 petition and then she'll apply for the Cr-1 spousal visa. when she enters the US with her visa, she'll become a permenant resident

Since you dont' want unnecessary delays and to expedite the process, I suggest you start researching this process. Start with the guides linked above.

there is no short cut, we file I130 to NSC, lucky the case was transfer to Missouri Service Center only take 44 days approved and got NOA2 in hand.

09/24/2012: I-130 NOA1 (Hard copy)

09/25/2012: I-130 Case Transfer to (MSC)

talk to a lawyer and take some advice..maybe she can come in Dec..u guys get married and apply for adjustment of status for her..she will get 6 months to stay in US maybe by then your petition will be approved...just a thought!! no harm in doing some research i reckon... :thumbs:

I don't think you apply for adjustment of status.

You still apply for an I-130 just like the rest of us.

She has no status to adjust.

Entering the US on a nonimmigrant visa with the preconceived intent to remain would constitute immigration fraud.

The I-130 immigrant visa petition is the way to go.

Yes that's one reason why she is going back after the marriage. I guess my point is though that we are not in a hurry for her to live in the U.S. before the process is completed. So it's not like we need to get her a visa to come be here with me as she owns her own business which we are not in a hurry to dissolve and she can stay there for the next 6+ months if necessary. But it sounds like the I-130 will be required regardless because it's a requirement for the IR1 CR1? Thanks all for your help.

Hmm perhaps it's possible to have dual citizenship? That's probably more complicated. (now I see that in Russia it's not illegal to have another citizenship so by proxy she will still keep her citizenship there so that's good news)

She can't have dual citizenship until she has a visa and lives in the US for X number of years and then applies for US citizenship.

She will sit in line like the rest of us and wait for her I-130 to be approved and eventually finish the CR1/IR1 and get a conditional green card. She MAY visit you while waiting, but she will need to hold ties to russia while doing so which includes but is not limited to any of the following:

• Current Paystubs with letter from employer stating intended return date

• Lease or Mortgage

• Bank statements with sufficient funds

I wasnt suggesting anything illegal...i have read about that on VJ myself and if u read the I-130 form it does ask in one question if the spouse is already in USA...and PLS re-read my post i did say take advise from the lawyer on my suggestion...im not that stupid to suggest anyone to do illegal things...it was just a suggestion upon what i read on Vj previously

the above demonstrates prior immigration intent. while it may seem to be a quick and easy answer to the ill-informed, it's wrong. the member's significant other would then have to demonstrate no intent at the aos interview. failure to do so can result in a lifetime ban on her.
