Do you need to have a job when applying for IR-1/CR-1 Spouse Visa ? My better half and I are wondering because he is finding it really rough right now being away from me and my son during the holidays and wants to spend time with us but the only way doing so is letting his job go. But we didn't know him not having a job while doing the visa process would hurt him.

He will need to be able to prove he can support you and earn sufficient income to meet the guidelines. Jobs are very tough to obtain in this economy. What if he can't find another job when he returns?

It certainly is not going to help. It's a hard process to go through...but, sometimes we have to make sacrifices to get to the outcome we want. If it were me, I wouldn't let the job go...whatever you decide, stay blessed.

The beneficiary does not need to have a job (the petitioner does not either, if they have a co-sponsor, but that is a different issue). Is your husband the beneficiary? It is sort of difficult to tell in your post.

silly to answer this but his money is his while he is working in Afghanistan and I earn my own income in the united states. we didn't want to complicate income with being apart

I think the point was to know who was quitting the job. His is not evaluated for the visa so it doesn't matter for immigration. Yours (USC) is important if you want to be able to sponsor him without a joint sponsor. Something you should be aware of is If he has spent a lot of time in Afghanistan, it is pretty likely he will be put in AP-- administrative processing or additional processing which is extra security checks following the interview. That could be a month or a year or somewhere in between. If he is not Muslim, then probably not as long as a year. So knowing it may take even longer than planned, will he be okay financially without his job for possibly months beyond the interview? Would having his extra money be helpful toward starting your US life together? If you're okay on those points, then quitting his job isn't an immigration concern since he is the intending immigrant.

It would help if you'd complete a timeline so we'd know how to better assist you. I thought he was the USC petitioner when I first answered your post.

While completing a timeline is a big help, I am still yet to see where it helps identify who is who.

Hence my signature as I was tired of people assuming I was the Canadian citizen lol

If "HE" is the foreigner, no problem for the spouse visa but if he wants to visit the USA during the process, it can be problematic for him not to have a job to go back to. One is often required to show or at least indicate they have ties to something outside the USA, like a job, that would compel them to leave the USA at the end of their planned or allowed visit. I would say that if he has visited multiple times before, it probably won't make any difference, because they don't ask a lot of frequent visitors who have demonstrated they will leave.
