Thanks I have used the example forms, still has a couple of questions though as the examples dont cover everying.

We can get a letter from her employer. Does the form not require 3 years of tax returns?? Or she can just put her 2011, Paystubbs since May 2012 and a letter from her employer.?

Robert! Look at the dang form. It has 3 blanks asking for dollar amounts from the 3 latest returns. They will know the amounts whether you mail in three tax returns or not.

2011 tax return, Paystubbs since May 2012 and a letter from her employer sounds like a good plan. Also use the money you brought over in the assets part. It counts if you feel she's a wee bit short.

Can someone please explain why it should be a © (9) instead of an (a) (6)? In the imstructions it appears that it should be (a) (6) if first time applying and within 90 days on entry.

Can someone please explain why it should be a © (9) instead of an (a) (6)? In the imstructions it appears that it should be (a) (6) if first time applying and within 90 days on entry.

Have you read the instructions/info next to each category? A(6) is only if you're applying for the work permit based on being a K1 holder. You will pay the fee, and it expires when your I-94 does.

If you file with C9, it's based on people filing I-485 (doesn't matter from what visa), it's free, and valid for a year.

K1's are able to get work permits prior to filing AOS, but as I said, you pay for it and it's valid until the I-94 expires. Seeing it takes about 60 days to receive, total waste of $300+
