hmm We DCF'd from a different embassy but I recall the I864 went in with the Packet IV documents. That means have your co-sponsor send it to you and you send it in with yours.

The sponsor and co-sponsor definitely use I-864.

If your wife is a US citizen your daughter is also a US citizen yes? Why would she be on an immigrant petition?

Discussion of "US National" extracted for entertainment:

Very few persons fall within this category since, as defined by the INA, all U.S. citizens are U.S. nationals but only a relatively small number of persons acquire U.S. nationality without becoming U.S. citizens. Thus, Section 101(a)(22) INA states that all U.S. citizens are also nationals of the U.S. However, Section 308 INA confers U.S. nationality but not U.S. citizenship, on persons born in or having ties with "an outlying possession of the United States." The outlying possessions are defined in Section 101(A)(29) INA as American Samoa and Swains Island. No other statutes define any other territories nor any of the states as outlying possessions. Those enumerated in section 308 INA as eligible for this status, in addition to those mentioned above, are those individuals born abroad to two American non-citizen national parents, or those born abroad to one alien parent and one non-citizen national parent. Also, there is a residency requirement placed upon the parents of the child prior to birth in order to transmit U.S. nationality.

Hi Guys,

it would be great if someone could help me out here.

We live in london and my wife is a US citizen /national and recently our petition (for me and our daughter) got approved , to my understanding now we have to complete ds-230 , ds 2001 and I-864(Affadvit of support) and send them back to the london embassy and get our medical done, we have already filled ds230 and sent it back, just waiting for police certificate to arrive so we can complete ds 2001 and send it to the embassy. my question is in regards to the I-864. my wife lives with me in the uk and does not work so we are using my wife's brother in law in states to be the joint sponsor to full fill the income requirement.

Now does the joint sponsor need to send I-864 directly to the embassy or he sends it to us and we take it along with us on the day of interview? or we need to send it to the embassy well before the interview?

And do we need to send all the orignial documents in support of our visa application before the interview or just need to take it along with us on the day of interview?

one final question? on i-864 form it asks if the sponsor is us national or us citizen ? whats the difference?

please if anyone can answer these questions that would be great.

Thanks

Thnks gstrength that clear all the doubts. 2 x i-864 form ( one from sponsor and one from joint sponsor) agreed!

but sorry for not being clear.. what i meant to ask in this question was. both our sponsors are basically sponsoring me and my daughter. now do we just need one i-864 from each sponsor for both (my and my daughter) of us ? or sperate I-864 for each one us?

Thanks

We have not started on the I864 forms yet but will also be using a sponsor (my husband) and co-sponsor (family friend). Our petition covers myself and our four sons but I think we are going to have just the two I864 forms with my kids listed alongside me on each form rather than having my husband fill out five forms and our co-sponsor fill out another five forms. We will be bundled together as one case anyway so it makes no sense to submit 2x5 copies of the exact same information. As I say, however, we are not at this stage yet so once we study the notes we might change our position on this.

Best wishes

Laura

hello, just go ahead and add your daughter in question 9, assuming your daughter is part of the same visa petition

Hi gstrength, that is the confusion.. i am not sure if it is the same visa petition or different petition? we have different LND case numbers but we are planning to move and apply for visa at same time. does that mean same visa petition or different visa petition?

Thanks
