Hi Guys,

it would be great if someone could help me out here.

We live in london and my wife is a US citizen /national and recently our petition (for me and our daughter) got approved , to my understanding now we have to complete ds-230 , ds 2001 and I-864(Affadvit of support) and send them back to the london embassy and get our medical done, we have already filled ds230 and sent it back, just waiting for police certificate to arrive so we can complete ds 2001 and send it to the embassy. my question is in regards to the I-864. my wife lives with me in the uk and does not work so we are using my wife's brother in law in states to be the joint sponsor to full fill the income requirement.

Now does the joint sponsor need to send I-864 directly to the embassy or he sends it to us and we take it along with us on the day of interview? or we need to send it to the embassy well before the interview?

And do we need to send all the orignial documents in support of our visa application before the interview or just need to take it along with us on the day of interview?

one final question? on i-864 form it asks if the sponsor is us national or us citizen ? whats the difference?

please if anyone can answer these questions that would be great.

Thanks

I am pretty sure you need to send all the documents prior to the interview as they need to be reviewed...and I am not sure what the difference is but I believe its on availability for visas like if US citizen theres always a visa available but if not then you would wait till one was available..I am new to this all myself but I was told to send all my documents prior to the interview but my husband and I also decided to send him with them as well that way we are prepared just in case :) hope this helps :)

Make sure he double checks every signature and have him send it to you first because the petitioner is going to need to sign it as well. I missed that signature and it's caused a delay in our application. In addition, the co sponsor needs to provide proof of status. A color copy of the biographical data page of his passport will suffice. Make sure he sends that too! I'm literally amidst an administrative processing due to the lack of both of those things. It's a hassle you don't want, believe me! Good luck!

You send the ds-230 and ds-2001 in.

You do not send the i-864, you take it with you to the interview.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks).
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE...
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time.
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case.
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied]

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) ....

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

2024: FML. Seriously. I'm done.

in regards to the I-864, you must assemble a packet containing: your wife's I-864, with all the supporting documentation and, the joint sponsor's I-864 with all supporting documentation. Check the instructions specific to London contained in your DS-2001 form or, you can call the IV Unit at the embassy.

in regards to the difference between a national and a citizen: According to 8 U.S.C. §1408 it is possible to be a U.S. national without being a U.S. citizen. A person whose only connection to the U.S. is through birth in an outlying possession (which as of 2005 is limited to American Samoa and Swains Island), or through descent from a person so born acquires U.S. nationality but not U.S. citizenship. This was formerly the case in only four other current or former U.S. overseas possessions1:

* Guam (1898 - 1950) (Citizenship granted by an Act of Congress)

* the Philippines (1898 - 1946) (Independence in 1946; Citizenship never accorded)

* Puerto Rico (1898 - 1917) (Citizenship granted by an Act of Congress; Puerto Rican citizenship exists)

* the U.S. Virgin Islands (1917 - 1927) (Citizenship granted by an Act of Congress)

No problem :)

There are 2 separate forms. Your wife will need to fill out the I864 and your joint sponsor needs to fill out the I864A. On the last page of the I864A, Part 2 'I the sponsor' etc, Line 14 it calls for the sponsors signature. I hope this helps :)

Thanks again Angela... i am getting all confused here now.. this is becoming so complicated... arghhh... i thought i864a is if the sponsor or joint sponsor is using income from house hold members? in our case , my wife lives with me in london and not working so so we are using her brother in law (who is in states) to be the join sponsor to meet the income requirement and his income is ok to sponsor both me and my daugther plus all his current dependants (his wife +kids) , so in that case do we still need to get i864a filled up? am i completely on the wrong page here?

Thanks a million for your help

Hrmm, There may be a different set of forms in that case. I've used my mother as the joint sponsor and she is also whom we'll be living with so she had to fill out the I864A. Nich-Nick and Holly are oracles of information regarding visa's and one of them are bound to see this thread and shed their wisdom.

I am sorry Angel but, that is incorrect. If you are using a Joint sponsor then both the sponsor and the joint sponsor have to file an I-864. If, you are using the income of a household member then the way to go will be: sponsor files a form I-864 and household member files a form I-864A

Also one last hurdle, the question in i-864 is confusing.

my wife and her brother in law would sponsor me and our baby daugther, now shall we just add our daughter in in question 9 (picture attached), or there should be a anothre i-864 for her?

Sorry but if your joint sponsor is not a household member then, you must file an I-864. One I-864 for the sponsor and, one I-864 for the joint sponsor.

Thnks gstrength that clear all the doubts. 2 x i-864 form ( one from sponsor and one from joint sponsor) agreed!

but sorry for not being clear.. what i meant to ask in this question was. both our sponsors are basically sponsoring me and my daughter. now do we just need one i-864 from each sponsor for both (my and my daughter) of us ? or sperate I-864 for each one us?

Thanks

hello, just go ahead and add your daughter in question 9, assuming your daughter is part of the same visa petition
