Okay this is what i got in the email back:

Hello

To make you a criminal record, I need as follow:

- A request with your signature

- Copy of your passport

- The address where you want it send to.

You can e-mail to the address below.

^^ .. how the heck am i supposed to send a request with my signature on it?? in the email to the adress below??

What i write it on paper take a photo of it then send it??

You/your fiancee write the letter in hand, sign and date it, then scan it and send it through email.

did that . what if tey start asking for proof of adresses? we ddont have that.

They won't want proof of address because it's irrelevant to getting a police record sent overseas. Basically, they're running your fiancee's name/passport info through their database, looking to see if anything pops up. If not, they'll send the police record to her with her full name on, their signature and stamp saying "no entry appears in the Central Crime register"(followed by some paragraphs and such). Since she entered legally with a visa, she could only have been registered as that person if she comitted any crimes, therefore the address is not relevant. Besides, she wasn't a permanent resident and proof of address is dificult to obtain as a visitor.

They won't want proof of address because it's irrelevant to getting a police record sent overseas. Basically, they're running your fiancee's name/passport info through their database, looking to see if anything pops up. If not, they'll send the police record to her with her full name on, their signature and stamp saying "no entry appears in the Central Crime register"(followed by some paragraphs and such). Since she entered legally with a visa, she could only have been registered as that person if she comitted any crimes, therefore the address is not relevant. Besides, she wasn't a permanent resident and proof of address is dificult to obtain as a visitor.

Theres a part on the aplication of the cr-1 that scares me..

It says if she has ever gotten in trouble with imigration before.. and they list when and ask for docments on that.

Now i thought you guys said it doesnt matter if she got deported or not?? if it didnt then why do they ask that?? I got half a mind just to put down No and get a new passport with blank pages and say she has livedin the philipines all her life.. I mean can they realy find out since it happend in denmarkk?

Yes...they can. But do what you want. Just don't complain if you say no and get caught.

No one here will advise you to lie on any form. Background checks are performed and despite info might not be in a new passport, it may still follow your fiancee electronically.

You can always put a post-it note by the question and write "see attached". On a different sheet of paper, you write "question 16 attachment" and explain the circumstances with facts; Your fiancee was an au pair and had extension of visa denied. The host family was obligated(as per the rules in Denmark) to buy her plane ticket however it did not happen in a timely manner.

While it WAS your fiancee's responsibility to leave before her visa was up, it was also not an option to just up and leave because the host family did not have the ticket ready in time despite their responsibility for their au pair. The overstay was 7 days and she had no intentions of staying beyond the validity of her visa.

Im sure there going to ask for a written statment claiming this from the employer and i know 100% she has no contact with them anymore.

I think you are worrying too much.

Be honest. She was deported from Denmark, not the States. Your honesty will be respected. If a lie is discovered she could be banned from the States for life.

It's fine to be prepared but don't fret too much. Having an overstay in a different country or having been deported won't directly jeopardize her chances. I'd focus more on the affidavit of support and the rest of the documents needed.
