Hello. I am New York resident who wants to marry a Russian citizen living here. She is here on a student visa and so I have learned that she will have to switch over her visa from student to fiance. I only wanted to ask what might be the first steps for us to begin this process. For example, do we have to wait until the student visa expires before applying for the fiance visa? Do we have to wait to get married until she has the fiance visa? Does she have to return to Russia in between or can she just submit all documentation from within the country? Any advice on how to begin this process and what I or her should be doing to prepare would be greatly appreciated.

Your fiance will not need a fiance visa, as visas are used to enter countries and she is here already. You two need to get married and then she does AOS (Adjustment of Status) to get a greencard. Here is a Guide: http://www.visajourney.com/content/i130guide2

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
