Hi guys,

Wanted you experts to review my cover letter and items to make sure all was in order. Also, we have our marriage license but our wedding isn't until end of December...we're technically and legally married so it should be ok to send in the I-130 now correct? Thanks for your advice.

Please find enclosed my Form I-130 Petition for Alien Relative on behalf of my wife, (wife's name). Please note that I am currently living with my wife in Vietnam on a work visa. I contacted the US Consulate in Ho Chi Minh City, and they told me that they no longer accept Direct Consular Filing. Therefore, I am filing my I-130 Petition with the USCIS. On my application, I have listed my US permanent address, where I intend to return with my wife in late 2012. Please also use my US address as my mailing address.

Included are the following documents:

• Personal Check in the amount of $420

• I-130 Petition for Alien Relative

• Copy of unexpired US Passport (Petitioner)

• G-325A (Petitioner)

• Passport Style Photo (Petitioner)

• G-325A (Beneficiary)

• Passport Style Photo (Beneficiary)

Evidence of Bona Fide Marriage

• Copy of Marriage Certificate from Vietnam

• Copy of Apartment Lease in HCMC where we currently live together

• Copy of Bank Statement showing Joint Account

• Photo pages as evidence of our bona fide relationship

According to this, this is the exact order to put things in:

- G-1145

- Payment in the amount of $ 420

- I-130

- I-130 Supplement: Explanation of Answer on I-130

- Explanation of Meeting

- US Passport (Petitioner)

- Copy of Marriage Certificate

- G-325A and passport style photo (Petitioner)

- G-325A and passport style photo (Beneficiary)

- Proof of Relationship

Where's you evidence of an ongoing relationship? Like phone call records, emails, IM's, text. letters cards. Visa stamps of travel, ring receipt, affidavit from family of relationship, maybe a relationship timeline. Just some suggestions.

Where's you evidence of an ongoing relationship? Like phone call records, emails, IM's, text. letters cards. Visa stamps of travel, ring receipt, affidavit from family of relationship, maybe a relationship timeline. Just some suggestions.

They live together so they're showing proof of an ongoing relationship that way. Phone records etc would only prove that they live together. With some relationships you need to front load, with others you don't.

to the OP: the cover letter looks fine to me, pretty much what mine looked like in format. :) Good luck to you! OH and don't forget to use the G-1145 on top of everything so you get emails and/or texts. You don't need to include it in the cover letter as you need to put it on the very top. Don't staple anything; use paperclips. :)

Paperclips or staples are minor things.

I would advice double check that you put your signature and date in your forms.

Thanks all for your replies and advice! I am a bit confused, I always thought we needed to bring all of that information (phone records, text msgs, chats, and other evidence) to the Consulate in HCMC and not needing to send it to the USCIS. I've read somewhere that the USCIS doesn't look at those and sometimes may not forward to the HCMC Consulate. At any rate, if it's better to add ALL the evidence then I guess it's safer than sorry. Will make copies to insure proper documentation.

Everything you submit at USCIS ends up in the hands of the CO that will do interview. The only reason I mentioned all the extra even though you live together because your Consulate is not an easy one. And they do want to see before, during and after ad ongoing stuff.

Sure USCIS I doubt reads and goes through all this stuff but they do approve the application and all thats in it. And you never know at interview time if you will be able to present extra evidence.

Depending on your consulate, you may have to front load (aka provide lots of information) at the start of the process. I'm not sure how Vietnam works, but there is a regional forum on VJ where you can inquire. :)

Hi!

Kindly give us correct information how to fill-in line 17 of I-130 form. My husband is the petitioner as he is the US citizen. The alien relative in line 17 refers to me as the foreign spouse,am I right. I am, by the way, a Filipina.
