Adjustment of Status: form I-130?

Hello everyone!

I finally got my K-1 Fiancè Visa and I'll enter the United States in December and me and my US citizen fiancè will marry soon after Christmas, yay! I am reading about the Adjustment of Status and on the USCIS site (here) they say for a Green Card we should submit 2 forms:

"Step One – Your U.S. citizen immediate relative must file the Form I-130 for you and it must be either pending or approved.

Step Two – After you receive Form I-797, Notice of Action, showing that the Form I-130 has either been received by us or approved, then you may file Form I-485."

I also checked the Visajourney "Step-by-Step Guide on How to File for Adjustment of Status for K1 and K3 Visa Holders", and the form I-130 isn't mentioned. I am kinda confused now! Are we required to fill the I-130 Petition for Alien Relative, or the I-485 is enough?

You apply for I-485 based on your approved I-129F petition and subsequent marriage to the petitioner within 90 days of arrival to the US, option C on the I-485.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

Yep, don't file for the I-130 or you're going to waste your money. :P

The cost of the AOS form is $1,070 total only. File also for a temporary work authorization (I-765=EAD) and temporary travel authorization (I-131=AP), as the fees for those forms are waived if filed at the same time of the AOS one. Plus, EAD and AP should be approved after 2-3 months, while your AOS application may take a long time. This way, you will be able to work and travel while your AOS will be pending.

K-1 Visa Timeline AOS Timeline

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

ROC Timeline

- May 19th, 2014 - Mailed ROC package to CSC

- Aug 8th, 2014 - Green Card received

N-400 Timeline

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.

- Now waiting...
