our I130 package have been approved, and head to National Visa Center. The question is can we delay the process? because my wife is pregnant for 3 and half months, and wants to give birth to our son in Vietnam before head over US. It this possible to delay the process for another 6 to 8 months?

USCIS Process

09/16/2012: I-130 Sent

09/20/2012: I-130 NOA1 (Receipt txt)

09/24/2012: I-130 NOA1 (Hard copy)

09/25/2012: I-130 Case Transfer to (MSC)

11/08/2012: I-130 NOA2 in 44 days after NOA1

NVC:11/19/2012: I-130 @ NVC

12/05/2012: Case & IID asign

12/19/2012: AoS paid n send

12/20/2012: AoS received

02/18/2012: IV Paid

04/15/2013: IV send

04/16/2013: IV received

04/25/2013: NVC case complete

06/26/2013: NVC send email notification for interview

07/11/2013: Interview approved

09/06/2013: POE @ JFK

CRBA: 05/20/2013: Approved

6/8/2015 - Removal of conditions - sent off packet to VSC
6/9/20015 - I-751 received in VSC

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

How long the time frame in the between the package. It the times frame gonna expire? because we dont want to miss the window of opportunity.

seems messy either way. if you delay it now and restart it up again, the CO will want paperworks or DNA test for the baby before they even think about issuing her a visa. i would go through the process now, birth out the kid and go through that process after the interview. the visa is good for up to 6 months, and that's best case scenario since they can still blue her for the pregnancy.

i dropped my son as a k-3 to CRBA after our paperworks was already in HCM and the process was smooth.

K-1, CRBA, AOS, GC

They will likely require that the child be born there to get DNA done... has happened to many others in the past...

I think you just need to continue the process. There will be delay regardless your wife wants it or not but I think that delay is shorter than starting over. Embassy will want your wife to stay and give birth in VN. DNA test will be needed to verify the child is yours.

Well, from this moment you will have about 9 months until her visa expires (6 months from attaining visa). Once the baby is born you will have about 3 months to get the CRBA and passport and leave the country. Since you are married there's no DNA test required. If you need to stay here longer, then I'd stop the process now before you have to pay the AOS/IV bills and redo it at a more convenient time. The main issue with having a baby here would be if you have the baby before your interview and your name is on the birth certificate, you would need to get the CRBA before your wife gets issued a visa.

This is actually a better idea. Once you pay the AOS/IV fees to NVC, you have 1 year to send in the i864 and ds230.

Please Note: If a period of one year passes without communication to the NVC, all submitted fees and

documents expire and must be resubmitted to resume the immigration process.
