hi, Can someone explain how does it work?

I'm about to marry my future USC spouse here in us. I´m here on my "visa waiver program", not over stayed yet.

We met 2 months ago and we cant live separated any more. I understand it is posible to Aos

WIll I still need the i-130 form ?if I´m here I cant find the info on any other topics.

-Where to send the documents? -where to get them?

Also anther important question: -

--I have dual citizenship british/ukranian ; I´am here on my british passport because Ukraine is not on VWP.

but all the documents I have to sign have only one box for "citizenship". For marriage I need to show my Ukrnian birth certificate and my british passport with my i94,

. will this not create a mess in my documents?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

hi , I posted in the marriage section because is all about Aos from marriage and not tourist visa( vwp is not a visa, is a program).

On other hand, I just read the guide and still dont know if I need i130 for my AOS.

The visa waiver program is generally considered a short-term tourist visa.

The guide is quite clear about needing to file an I-130.

You are adjusting from the visa waiver program, NOT from a family visa (a fiance or spousal visa), so this is the correct forum

If you read the guide, it is very clear you need a I-130- it is the first of the forms mentioned for download.

For example in the i 485 I find " citizenship/nationality" in the same box,

do I need to put them both?

Also : Will I file the documents or my USC spouse?

Sorry for all obvious but I´m looking for confirmation for all the topics I read in the last weeks.

Nothing beats experience in this cases

Doesn't matter which one you put in the box. I'm dual UK/Aussie. I only listed Aussie.

Your US spouse will be the one that does the I-130 and yes he needs to submit documents, including proof of income above the poverty guidelines. You complete the I-485 and together that's $1490. You also need a medical, the price for which varies. That's all filed together as well as a few other forms.
