you get a bigger refund than if you file separtate?

or a bigger relief of tax burden.

Interesting, I had a tax accountant doing my taxes last year. As my wife never lived in the US and also does not have a SSN or TIN, he told me to file as single.

To all you CR-1/IR-1 spouses , it's getting to be tax time. What do you file when your spouse is living in another country? I usually claim head of household, I'm thinking that still applies but I think I must put somewhere that I'm now married?

My husband still isn't here and I filed Married filing separate. No ITIN needed or SS#. It was cool to get my 2011 Tax mail letter in both our names.

I think it should be clear the only reason I'm allowed to claim head of household which I have been doing since my divorce of my first husband, is that I have dependent children LIVING WITH ME. If my husband was part of our household next year we would be claiming the married filing jointly, UNLESS he wasn't living here for more than 6 months of the year. With the rate USCIS is going it could be the case again for next year! As the saying goes two things you can count on is death and taxes, AND the 3rd= waiting an enormous amount of time for your NOA-2!

Yes and also if you file jointly with an ITIN number you can not claim some of the tax breaks you get as a single parent and this is money I count on to get me through the year. I followed that link posted in the beginning of this thread and it said to file HOH and so I will do that again this year. And when my hubby finally gets here we will apply for a ss# and file married filing jointly.

Agree :thumbs: my husband has his ITIN number ... But still waiting on my refund! They say 12 weeks it's been over that now so I called IRS 3 days ago and was told my file is on someones desk still being worked on WTH... give it another 3 weeks!

If you mean income tax return, then by law, you are required to receive your w2 by the end of January, I believe.

So following that, you can start filing in February or earlier if your employer gives it to you earlier.

I am still in the Philippines (unemployed) w/ our biological child.Me and my child are not yet eligible to get an SSN.My child was born before my husband was Naturalized.We've been married for four years now and still his status in IRS is 'SINGLE'.

I already have the 2 fW7's (for me and my child) signed and ready along w/ the notarized supporting docs.From the IRS website, it says we should be 'MARRIED FILING JOINTLY'.

My questions:

Could applying for ITIN be done anytime now? Or do I have to wait until my hubby files for his ITR by Feb/March 2013?

Is it correct that I prepared another fW7 for my child(he's 2 y/o)? I want him to be added as dependent.

You file the ITIN WITH the taxes.

As for your question on your child, I'm sorry, I don't know.
