Dear VJ family ,

I have a question about adjustment of status . I would like to know as an approved fiance i-129F visa ,

when i arrive in the states do i apply first for the work permit, and then apply for adjustment of status I485.

Do i have to apply for the two together? I need to be able to work right away and id like to adjust my status a bit later .

Please Advice .

Your plan won't work. You first need to get married, then apply for AOS; when you do so, you can apply for EAD at the same time, and will get it 3-ish months later.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

If you apply for the EAD before your AOS, then you will have to pay $380 and the EAD you receive will only be valid for as long as your I-94 is. Since it takes 2-3 months to receive the EAD, it is a pointless waste of money. Get married and file for AOS right away. When filing with a pending I-485, the fees for the EAD and AP are waived. The EAD you receive that way will be good for a year and can be used to start working while waiting for the green card approval. http://www.visajourney.com/content/k1k3aos

I agree with Jay-Kay. Get married as soon as possible after your entry, and file for AOS/EAD (work permit)/AP, all at the same time and for the price of the AOS only ($1,070). That's the best solution in my opinion. :)

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received
