Hello,

I'm a first time poster on these forums and would really appreciate your advice on a current issue that my family is facing. In a nutshell, my stepmother filed a petition for my younger brother about a year and a half ago due to the fact that my Dad only had a green card at the time (he is now a US citizen). The paperwork went as far as the last stage of the process but was withdrawn by my stepmother due to some issues/arguments with my Dad. Anyway, the issue got solved and my stepmother decided to continue the process. A couple months after this happened, she decided to cancel it again for some other reason (I don't know the details). So, my brother is sitting waiting for the issue to be solved while the paperwork isn't going anywhere. My Dad is now a Citizen and can file an independent petition for my brother but claims that he cannot do anything due to the fact that a petition is already filed for my brother. Has anyone ever seen anything like this?? Your advice would be really appreciated. Thanks!!

A beneficiary can have multiple petitions filed on their behalf. Your father, provided either (1) he is your brother's natural father; or (2) he is your brother's stepfather and became married to your mother before your brother turned 18, is qualified to file an I-130 on your brother's behalf.

What!!! wow, that's the information that I was hoping for. I think that my stepmother doesn't want the process to go forward therefore she has been misinforming my Dad by telling him that one petition has to be cancelled in order for another one to start. I'm so happy that I stumbled upon this forum! Thanks guys!
