yea definitely. I just think when there is history of fraud its makes it just so much more difficult and the embassy sometimes can't really figure it out I dare say they take some guesses about which relations are bonafide??

Doing it all day every day and having a wide array of access to data bases and investigations should in my humble opinion make them a bit sharper to differentiate between a definite scammer with hard proof and a regular guy without as much as a dot on his case. It is the speculation and assumption, the gut feeling that tips the CO that must stop. No factual evidence ~ issue the visa. Clean docs, no interview issues ~ issue the visa. That is not happening. Something amiss there.

well rade2rising i understand what you are saying.. Well i don't Blame the CO, we know Nigerians are really invovled in all kind of ###### ,but to me America is not a place were u go and your life will automatically change for the good...Like i said before,i don't blame the consulate because they have seen many fraud cases and they don't know how to separate the good from the bad ...Is really Difficult ,but anyway i know God's hands is in this ,so everything will be put in order before any futher step is taken.. But i will still like to know how many months it will take the Embassy to send the Case back to National Visa Center....

Read my signature to see my case return / receive dates. It can be 2-4 months. Have the senator inquire the diplomatic pouch number to track the case. Have the USC stay on top of the case every 2 weeks or so until it has been received by USCIS where it will go to storage for an approx. additional 180 days and be allowed to expire.

yea buddy I know this is difficult news even I dont know how I could handle hearing a denial but you must stay strong. waiting for the petition to get back to USA will take long time and go nowhere. you should try to marry then file for spousal visa.

My dear getting married is not a strong evidence that you will be given a visa ....My finacee need the wedding in her own states were are families and friends can come over,so i don't want to stress over that issue of getting married in Nigeria ...

I am just intrested about how many months it will take the Embassy to send the Case back to National Visa Center...

I gave you the answer above about the time table.

Though a spousal visa will not be a guaranteed approval keep in mind that they can deny the K1 a second time around.

The good thing about a spousal visa is that it will not expire like a K1 and will definitely be reviewed if returned again and can be appealed and has more power to the punch.

Bingo. It's sheer ridiculousness.

Also just about a week ago, a CO got furious because the beneficiary showed a picture of her and her Fiance taken in front (ish) of the embassy? It's a freaking government building that belongs to the tax paters for the love of God.

Because its against the law and its clearly stated in front of the building no photography. I know we may all be innocent law abiding people. But we have had our embassies blown up. Everybody standing in front of an American embassy isn't there to immigrant there are many plotting and planning all over this earth. Yes its to bad that happened. But sorry the sign is there I know I saw it clearly. But I am a military child and I know about what you cab and can not do around an embassy.

I know where you're coming from and I understand but this goes to show the idiocy of what happened.

I don't know the OP personally but her conduct and character on these forums assures me that had she seen any sign or was aware (she's not a military brat) that it was illegal (I am not aware of any such law as an example) to take a picture of an Embassy then she wouldn't not only not done it but she wouldn't have submitted the evidence to the said Embassy as proof.

My point is that this goes to show the lack of emphaty and common sense. A simple did you know that it's illegal to take a picture of an Embassy question to the OP and a genuine answer of we were not aware should have sufficed. There's no reasonable thought to use that as part of the denial process, IMHO.

Citizens take pictures of federal buildings all the time and it its prudent for a layperson to assuem that it is okay to proudly take a picture of an Embassy.

"They" need to start using a little bit of common sense and I think their "absolute power" is starting to corrupt them. I move that had the picture been taken in Canada or Switzerland that it wouldn't have been an issue.

Do NOT do a mock wedding , it will cause so much problem. They will deny the second visa.

Is there a big age difference between you ?

I think the CO worried about the email because some women get hit up by romance scammers ( people that create profiles on dating sites as well off people with lots of issues that require money to fix) Some of these deluded souls will still stay in "love" with the scammer when they say ''' I have to confess I am not a white man stuck in Africa but a african and I feel so bad for taking your money , I love you" and then petition for the scammer to come. To the CO your email having another name hinted that you fell into this group. You need to be vary careful to cover your relationship next time.

Getting married is not the cure. The second more complete petition is. Second petitions rarely result in denial. Yes she should visit again and stay for a longer time.

There is nothing bad about courthouse, you do this for the paperwork and then have a real wedding after a while. Anyway it takes time to prepare everything for the wedding and you need to rent almost anything at least 5 months ahead. We went to the courthouse and we really had a good time that day, I was very happy, and now we are planning our wedding for June. If you have another interview be yourself and honest, say what you really feel, and of course short and clear to the questions. Don't ever mention about money, like "we want a better life or "show evidence that she sent you money or anything that implies money and proves you want to go there only for money. When you love the person you don't care about money, you just want to be with him/her. Try to bring more evidence, if she comes to visit you show her to your parents and take photos, my consular was interested to know how my parents reacted when he told them in my language his feelings to me, in that moment I felt like she was my friend but not the consular. Don't forget that they are good psychologists, they can tell when you are lying and when not. Good luck!

If you want a wedding in the US file for the second K1 there is little chance they will deny a second time if you file a good front loaded petition that addresses the issues with the visa. Everyone that says the If you want a US marriage then that is what you want.

This will not be over quickly. You will not enjoy this.

In most cases DHS/USCIS will not contact the petitioner upon receipt of the petition because of the short validity period of K-1 petitions. You are allowed to file a new petition, or marry Applicant and file for him to immigrate as your spouse.

We would advise that you contact DHS/USCIS with any additional inquiries as the case is considered closed in Lagos.

If you have any further questions, please do not hesitate to contact us any time.

Forget the K3. You either file a new K1 with a front-load of evidence or you meet somewhere on the planet and marry and file a CR1/IR1.

First petitions at Lagos are a risky thing, lots of both type get denied. It is the second petition that rarely gets denied as long as it is well prepared and there are no real issues. Two of the denied second petitions I know of where both CR1's one relationship went down the tubes and the other fought the NOIR and they are here in the southern california area.

This will not be over quickly. You will not enjoy this.

The K3 is obsolete. Enter "K1 obsolete" into the VJ search bar and read a gazillion posts on why if you care to know.

You either file a K1 or CR1.

Visa Received : Nov. 3 , 2014 VISA IN HAND.

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Thank you all for you advice, well i have not been here for a while , . I just want to inform the house that i was approve the visa , my finaceee later came to Nigeria and we got married and fill in for the cr1 visa, and last week thursday i was approved the visa and i am going this week for collection. Thank God for his Mercy and favoured upon and thank you all for your contrubution and advice. And special thanks to all the staff and crew of visanow for assistanting us till this time. Please the consulate said i have to pay 165 dollars before entry the united state , i will like to know if anyone can help me or tell me how i can pay that money because they said it has to be paid via online,
