How do I answer question # 16 where it asks if relative has been under immigration proceedings? Is this a yes or no considering the previous K1/Visa?

This is a yes. The K1 visa is an immigrant visa so i think it should be listed, just like I wouldn't list an unsuccessful tourist visa

The answer would be no. Your fiance was denied a visa but has never been under a proceeding Those are things that generally involve hearings like deportations Look below the question. Unless you check one of the boxes the answer is no.

This will not be over quickly. You will not enjoy this.

I dnt think she needs to change her name on her passport since she will have the marriage cert alongside as proof. on her I-130 and G325 forms you could use her maiden name as main name and then her married name as other names used. how much did you pay for the passport? if you decide to go with a new passport it shd not cost more than 20K unless you were under so called "express" process used by those agents to milk people. so apply early so they won't charge you rush service fees.

I have also always understood immigration proceedings to mean real negative process like deportation, etc so i do not think your recent K1 denial shd count.

we did not stress much on co mingling of finances cos we also did not have all those things. remember the I-130 instruction portion mentions a lot of "OR' which you can use to substitute and proove your bona fide like affidavits, and other things. we had his sister, my sis and mum swear one each for us. we asked our landlord to give us letter with his company seal saying "mr and Mrs ... have been renting one of my flats since so period and will renew their lease come this month 2013( Nigeria does not have standard lease documents except payment receipt for rent).

Before our marriage I had obtained life insurance and added him to it as beneficiary( fiance) now I plan to update it to husband.Then pics of you guys together at random moments among other people and actual flight boarding pass or ur trips to see could be chipped in with ur application to show BO NA FIDE lol.

just the forms, the g325 for both of you, two of those options listed by USCIS(if you have more, fine) to show bonafide and everything else to serve as frontloading and you will be fine.

10/12/2012: NOA 1
12/17/2012: NOA 2 (case was transferred to NYC office 11/27/12)
NVC stage ( 20 days)
01/08/2013: Case # and IIN assigned ( file arrived NVC mail room 12/20/12)
01/09/2013: AOS invoiced and paid, DS-3032 emailed and mailed.
01/16/2013: IV invoiced &paid. AOS & IV mailed in one package(arrived 01/18).

01/28/2013: Case complete!!!
04/19/2013: Interview; APPROVED!!!!!
05/13/2013: POE; JFK

IR-5 for Mom Entire process took 5 months exactly

NVC: (19 days)
Case entered and # assigned: 2011-11-18
NVC Case COMPLETED: 2011-12-07 ( 43 days from NOA 2 and 65 days from NOA 1)
Interview Date(Lagos): 2012-01- 23
Mom was late for interview
New Interview date: 2012-02-29 : VISA APPROVED

Yikes Thanks for the correction. Guess I got lucky on that one. These forms can be clear as mud sometimes.

Heck yeah. I filed married filing separate. But if you want to file married filing jointly just apply for the ITIN and doing your 2012 taxes. Izzy pizzy. I got a letter from IRS addressed to us both it was so surreal like OMG IRS has us both now.

Okay so what proff did you attach to the W7 when you applied for the ITIN?

Did he have to go to the Embassy to get the copy of his passport and marraige certificate certified by them? I'm confused on that.
