So I started looking at the I-130 and some stuff jumped right out at me.

How can you show joint ownership or property, lease of joint tenancy, and co mingling of financial resources when you don't live in the same country?

In the first post, though, you can accomplish most of that within a month of returning to the USA.

We didn't show any records of these Cos there's no way we could have them while live in different countries.so I don't think that should be a problem.

One thing I did for my husband was to add him as an authorized buyer on my credit card. You don't need a SSN and his name appreared on the paper statements. Once I did this he started getting junk mail. I was also able to add him to my insurance, medical and life. Nothing says commited like making you my beneficuary. We also established a "business" there and got the licence with both names.

Joint property doesn't have to be in the US. You mentioned retirement plans in Nigeria. Maybe something there. Build some BQ and rent it or have her living in it. Even if it is somthing you sell later to move to better location, investment is investment.

This will not be over quickly. You will not enjoy this.

glad to see you are looking into the spouse visa.

If you look at my timeline, It wiil give you an idea how this is going to play out.

I will not stress over the joint assets as that is not feasible for everyone.

Once you get all your stuff ready, go to Nigeria and marry her. Also take the forms to file joint taxes for next year. That will sereve as co mingling of resources for both of you. Have a copy of her ID cards, voters cards, passport informaation to send to IRS when you file next year.

Going ahead with the CR1 will "force" them to send you a NOID from CSC which you will respond to, to enable yout CR1 move forward and make them close the K1.

The CR1 doesn't force a NOID , the k1 will simply be closed as being moot. A second K1 forces the review of the first one.

According to Mark Ellis refiling a CR1 will or can also force a NOIR.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Wait a minute, so even though she's in Nigeria I can file as married on my taxes?

The case Marc talks about is K1 to K1 he only speculated at that time the it would apply to a CR1 and I never have heard of it from a CR1 where it happens with a K1 frequently.

I pulled a quote from the link in which he briefly mentions the CR1 refile. It is on the bottom of the paragraph.

If you file

an I-130 after a K1 was refused, address the reasons it was refused

when you file. That may save CSC the necessity of sending you

an NOID (K1's) or an NOIR (CR/IR-1's).
