hey everyone i am very confused and need some help i am on B2 which is valid till 2016 my brother is US citizen i applied for COS on 1st of october and my i94 expires on 8th of december school which i want to attend starts from 14th of january so there is a gap of 5 days in which i will be out of status i heard i can not be given F1 visa status 30 days before the start of school

I am not sure to be very honest...especially because I don't know what legalities go with applying for COS. As far as I know, if you step out of US anytime while your COS is pending that means you have abandoned your COS application. That means, if you left the US before your COS has been approved than your application will be canceled. You'll have to get a US visa stamp prior to being able to leave without any issues. Ans, if your COS has not been approved by January 14th, you cannot start school as your visa, B1/B2 does not allow individuals to study in the US.
