Marrying on the tourist Visa

Hi, Im a US citizen. However, I have a friend that is here on a tourist visa and she wants to get married to her boyfriend who is a US citizen. They live together now, while she is here visiting.

My question is, can she get married on the tourist visa? How can she prove that when she entered US wasnt with the intent to get married?

If she has plans to return to her home country to complete her immigration visa process, they can marry, her husband can file the petition for her visa and get the process started. She can stay in the US for the time allowed in her I-94. There are no restrictions and this is the by-the-book safest route.

If however, she is planning not to leave and do her AOS in the US, her intent upon arrival may be questioned by the USCIS during the AOS process. Each case is different and despite the fact she may have had no intention of staying, there are no guarantees that the USCIS will take her word at face value. They may require additional evidence of their relationship, they may pay visits to their home as a means to verify their claims their marriage is not for the purpose of her acquiring a green case alone and there are cases where both may be subjected to the infamous interviews in separate rooms. As a rule of thumb, if their marriage is legit, they should come out fine at the other end.

The answer is yes. If for some reason she's asked later on about her intent when she entered, make sure she can provide proof such as a return ticket, lease agreement/mortgage, anything to show ties to her country and that she didn't tie up loose ends before she came to the US. I doubt she'll be asked, but one never knows.

Once they marry, they will need to file the packets for I-130, 1-485, I-131 and I-765, if she plans to stay and adjust her status from inside the US. Make sure she's aware that once she files for AOS, she will not be allowed to leave the country until she receives advanced parole. You can find information for compiling the above packets on this website.

My husband came here the same way, he had absolutely zero intent to stay here when he arrived, but long story short, plans changed & we ended up getting married 1 week before his stay expired. We're going through the AOS process now so let me know if your friend has any questions.
