Hi everyone, I have a question about refiling. My fiance and I were denied at our interview in Lagos last year in November. We were not given a reason, other than "FOR IMMIGRATION PURPOSES ONLY-DENIED" stamped accross the top of our petition. We are refiling, but have a few questions. We were granted a waivier of meeting based on my medical condition that prevents me from flying. We think we will have a better chance of approval if we meet in person before filing, but he will have to come here on a visitation visa. Won't this look suspiscious since we already filed for a K-1? How do we go about this? Does anyone have an idea? If he were to come on a student visa, wouldn't that also look bad? How do they expect us to meet? How do we even know what it was that caused them to deny the petition in the first place?

He will not get a visitor visa or student visa and it would look bad to Lagos if he applies for it before you refile.

Perhaps you can meet in a third country where the flight for you would be much shorter and where it would be easier for him to get to. Lagos does not expect you to meet, marry or live happily ever after, they expect to see evidence of a bona fide relationship and meeting in person is one of the basic requirements for Lagos even if USCIS approved you on a waiver.

They don't care what medical problem holds you back and the burden of proof is on you.

It is rather late to fight your returned case which was almost a year ago and your senators should have been involved at that time for a (very)remote chance for a second interview. At this time your petition is expired.

I don't see Lagos approving you the second time around without meeting either.

You can consult a very good attorney for advice but it must be one familiar with Lagos' difficulties and experienced with

turn arounds with similar cases like yours in 3. world countries. (USCIS approved waivers refused approval by CO)

Otherwise you are wasting your money.

I am sorry for your circumstances and see as only option to overcome your medical issues and meet. Even that will not guarantee

that he will be approved. Lagos prefers several visits and favors a spousal over a fiance visa in a case like yours.

I actually did contact 2 senators and 2 congressmen within weeks of our denial, and their letters of request along with my lawyers information, was sent to Lagos, and USCIS. We also contacted the Ombudsman in DC, and had an appointment with the local USCIS office to ask them for a review or reopening of this case. We had stacks and stacks of evidence of our relationsip. The system is so messed up. Does anyone know of any groups working for reform of the system? I have found some groups claiming to want reform, but they are mostly hispanic people working for hispanic rights, not really reform of the system. thanks guys

How far can you travel ? Can you go on a train or boat ? Can you travel at all in a plane ? I would start looking at other places a Nigerian can travel without a visa ( there aren't a lot ) and see if they are in your ability to get there. THe list I find is below

The easiest way to list all the countries you may visit visa free is to split them into continents. In the Americas you may access Barbados for six months, Dominica for 21 days, Grenada, Haiti, Saint Kitts and Nevis for three months and Turks and Caicos Islands for 30 days.

In Asia you can freely arrive in the following countries to which you will then be issued with a visa once in the country. In Azerbaijan, Cambodia, Laos, Macau and Timor-Leste you are granted with a 30 day visa. In Bangladesh you are granted a 90 day visa.

In Europe you may visit Kosovo for 90 days. In Oceania you may access Micronesia, Nauru, Niue, Vanuatu and Palau for 30 days, Cook Islands for 31 days, Tuvalu for one month, Samoa for 60 days and Fiji for fourmonths.

In Africa Nigerian passport holders can visit the following countries visa-free; Benin, Burkina Faso, Cape Verde, Cameroon, Chad, Ivory Coast, Ghana, Gambia, Guinea, Liberia, Mali, Mauritania, Niger and Senegal.

This will not be over quickly. You will not enjoy this.

That is incorrect ! I know what I am talking about. I spoke personally with him for a long time and exchanged emails and he is filing another one very soon. He needs people from Oregon but other states are welcome too. His previous one was dismissed for various reasons. I also received his question forms in case I will join the litigation a few days ago.

The 9th circuit court declared the lawsuit moot because the plaintiffs in the Tran lawsuit had eventually gotten their visas. This happened on October 25, 2012.

October 25, 2012 - The Ninth Circuit dismissed the lawsuit as "moot" because the plaintiffs had obtained visas or were no longer pursuing visas. While this is the end of this lawsuit, our firm will seek to file a new lawsuit with new plaintiffs, and will seek to avoid the mootness issue through early filing of a motion for class certification. If you wish to participate in the class action, please complete the questionnaire and send it to Brent Renison.

My point of the link was to show the phone number of the attorney in order to participate in the NEW lawsuit which will be filed and my response of "incorrect" to the previous poster was in regards to her saying "there is nothing to join."

One couple in the previous lawsuit had chosen to marry mid course and that made it moot also.

A slightly different procedural approach will be taken the next time.

Yes, I have already spoken to Brent Renison. I talked to him yesterday, and I am going to join the lawsuit, but as you know, it will do me no good with my problem. It will however help others in the future who file (hopefully). As I stated earlier, I want to work to change the system, and I will do as much as I can to do that. As for my case, we are going to meet as soon as possible, and refile. We are just praying for a miracle. Our biggest obstacle is money. Does anyone know of any philanthropist, or organization etc. that would contribute to our cause?

Brent Renison is the former pro-bono counsel for the group Surviving Spouses Against Deportation, a pressure group which campaigned against the widow penalty and was one of the leading voices leading to its repeal in 2009. He has been very helpful in consulting and exchanging emails with me regarding issues with obtaining my green card.

I would certainly urge anyone thinking about it to contact him, the guy means business and gets results.

i went to the embassy yesterday ,i was denied the visa....

Consulate:This is the letter they gave to me ..This Office regrets to inform you that it is uable to issue a visa to you because you have failed to convince the consular officer that your relationship with the petitioner is Bona fide ..You case will remain pending under section 221(g) of the immigration and nationality act while it is return to the national visa center for their review ..When their review is complete,they will contact the petitioner who will then have the opportunity to respond.. Please do anyone know how long it will take for the case to be forwarded back to National Visa Center,and do we have to continue with the K1 visa or my finacee can come down for the marriage here or she can come for the second time..Please somebody should advice please...Thanks

i went to the embassy yesterday ,i was denied the visa at the lagos embassy in Nigeria....

Consulate:This is the letter they gave to me ..This Office regrets to inform you that it is uable to issue a visa to you because you have failed to convince the consular officer that your relationship with the petitioner is Bona fide ..You case will remain pending under section 221(g) of the immigration and nationality act while it is return to the national visa center for their review ..When their review is complete,they will contact the petitioner who will then have the opportunity to respond.. If the case is reaffirmed,we will contact you to set up a new appiontment date..If the case is not reaffirmed,the petitioner will be notified and the national visa center will close the case
