Hi,

I applied for the N400 in September. I have interview coming up in 2 weeks. I have been married for more than 5 years. I am not applying based on marriage. This year I was arrested for DV (Domestic Violence) charge, sent to jail and released after 48 in February. My case was dismissed and recently was expunged as well.

I have two problems at hand, one is DV and I recently filed taxes for 2011 and looks like I owe taxes. I did a payment agreement with IRS and with state and will be sending my payments to them. When i applied for N400 in September, I only had the DV issue and not the tax issue. So I mentioned I don't owe taxes as I had taxes taken out in payroll and didn't know before hand.

I want to ask.

  • Will I be asked about taxes
  • With Dv will my case have chances of getting denied, because of good moral character (Moral Turpitude)

I would really appreciate your help in this regard, as this will help and other who might be in the same boat.

You certainly have to bring up these issues or risk getting deported. Without knowing all the facts, one can only guess about the outcome. You have to bring in all of your evidence in regards to these two issues. Maybe you should even hire an attorney to go in with you, have no way of knowing.

Thank You for your reply. I applied my paper work for n400 via a lawyer.

You certainly have to bring up these issues or risk getting deported. Without knowing all the facts, one can only guess about the outcome. You have to bring in all of your evidence in regards to these two issues. Maybe you should even hire an attorney to go in with you, have no way of knowing.

1) DV

Your case was dismissed and expunged. That means it's a non-issue.

2) Taxes

If you entered into a payment agreement with the IRS, that means you are on good terms with them, so that makes this a non-issue as well.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . Thank You so much Brother Hesekiel for your reply. Does this mean that I have chances of getting my case approved if i clear the civic test. Since i didn't lie about anything while filing N400.

During your interview the IO will be going through your N-400 form with you. That's the time you can tell the IO about your tax payment plan with IRS. The IO will note it down on your form.

If you pass the English and civic test, I don't see a reason why your application should not be approved.
