Hi sandraj, I just have another question hope you could help me again. I went to Social security office, and tried to apply for SSN, she said that I could not get SSN unless I have my green card and passport. I don't have my passport because it has been turned in at the immigration court. I thought if I already have EAD I could get a SSN while I'm waiting for adjudication od my I-360. Thank you!

You can receive a social security number if you have either an EAD or a green card.

If you showed them an EAD and they still would not give you a number then ask to talk to a supervisor - they are wrong. You may be asked to show your birth certificate, but they are required to give you a social security card and number upon request if you present an EAD.

Actually the person I talked to at the Social security office went inside probably she talked to her supervisor, she kept telling me that I should have a legal status to get SSN...thank you for the infos though..

Fajrakatna most of Social Service Office require just the DHS document in your case the work permit should be enough. But i saw some offices asking proof of identity as well and then they accept U.S.driver identification card or birth certificate and respective translation.

I also tried to present my washington state ID and said they wont accept anything only paasport and greencard. Is it also common that DSHS will require us to get SSN in order for us to be eligible for food stamps? Thank you.

What do you think would be the timeline if the petition was filed and approved as a marriage based to the LPR, but received the greencard as a marriage based to a citizen? I am not sure if the 3 year rule can be applied or not as the divorce happened before my approval and before his naturalization.

If you received your green card based on VAWA and marriage to an LPR you must wait five years to apply for citizenship.

If you received your green card based on VAWA and marriage to a US citizen you can apply for citizenship after three years.

They are wrong.

Numerous people on these forums have received a social security number using nothing other than their EAD and (sometimes) birth certificate, including myself.

I have one question regarding VSC,Vawa has been reauthorized by Senate and House. Obama signed into law. I can see that USCIS vermont is processing June 5,2011 right now because vawa expired in Oct ,2011. I can see achieve USCIS processing times and based on that i can see that they did processed vawa within 5 months.

I think sandraj and another experience person of this forum can answer.

Indianguyyy the timeline won't change at all. VAWA was active before the reauthorization. The reauthorization was to expand the act to protect american indians living in reservations, undocummented individuals who are victims of domestic violence and same sex couples and more money to investigate and prossecute the abusers.I remember 4years ago Vawa was adjudicated in 6months but now we have 12.000/15.000 Vawa petitions per year.

yes may be you are correct but i am talking about USCIS processing time for case. USCIS will take 12 month or 24 month to adjust case. but it stopped looking at case after OCT 2011 when vawa expired.

See here processing time

I-360 Vawa June 5 ,2011 - 5 month Aila website

I-360 Vawa November 14,2011 - Apr 25,2011 means retrogressed -aila website for USCIS processing archieve

In two years Feb 5,2013 it still moved two months from Nov 14,2011.

so there is something wrong.

Feb 5,2013 - I-360 Vawa processing- June 5,2011
