Faithkeeper welcome here. USCIS can contact any person that gave you an affidavit in suport of the vawa case.In the case you mentioned probably the Vawa filer mentioned her son witnessed the violence and he was available to give any aditional information and because of that they contacted he son.They are not allowed to call the abuser of course.

Point taken Sandranj thanks lordhelpme too for your input *sigh* just wish and hope I dont have to put my son through the process this is a battle mommy would of want to fight alone hes been through enough already emotionally too with his step-dad and even after almost 3 yrs he speaks of it ever so often.

The Ombudsman can only intervene when your case is outside normal processing times or if you believe that USCIS have made some kind of error or mistake on your case.

hey singledad2usc,I tried to renew my license in new jersey using the prima facie but they would not accept it or rather they did not seem to have any idea what a prima facie is. I guess it depends on the state you are in. some states will accept it and others will not.

hey try to go to different offices and try to talk to a manager instead, when i went thats what happened to me, :yes: i dont live in NJ tho

u r all correct: it's somewhat of a random process. Years ago, NY renewed my license without even looking at anything. Today, this is what they did: the girl takes a copy of SSA letter and PF, and goes to supervisor. Supervisor sends her back to copy my foreign passport as well. ok. Then, I sit half-hour while they fax these papers to Albany for approval. What came back was laughable. The person in Albany, who can't even spell, wrote her "determination" (I'm glad I kept this fax, so I'm quoting her to the letter): "SSA Letter Not Good. Need New Letter Plus Need Imigration Paperwork" Imigration Imigration Imigration

What she found "not good" in SSA letter was their standard sentence "You have not given us the documents we need". So I'm explaining to the girl: at SSA, I did question their format - but they responded to me twice: "that's our standard format, that's what we issue everyone requiring DMV letter"...Useless

I'll ask my lawyer to write a cover, and will take this to different DMV next week. And strange thing at Public Assistance, but apparently that's NY standard: they say PF is good for Medicaid and Cash, but NOT foodstamps. Go figure

Hello all,

I hope everyone is doing okay.I havent been on the vawa forum for sometime .

I have a question if Sandranj can help me or anyone who may have an answer to my question I would really appreciate.I obtained my GC through vawa and soon I am eligable for cititenship.At the time I filled my now 18 year old son was 14 and the other one will be 13.I included them in my vawa petition and they too got the GC through vawa.My question is that I do qualify under the 3 year rule as an abused spouse of the USA citizen to obtain citizenship as for my kids I am not sure if they do qualify under the 3 year rule or they should wait for 2 more years to make it 5 yrs through they obtained green cards through me as an abused parent,the kids are mine and were step kids to my husband .Thank you for your help : )

ladyg in your case your children do not need to request U.S. citizenship, it is automatically conferred when you naturalize, once they are under 18 years old, but for those over 18 years old they don't have "Derivative Citizenship" and then they have to wait 5 years if the parent got GC through Vawa.
