hi sandraj..I just want to ask, what benefit you can get by applying a motion to administratively close the removal proceedings? If it is granted, does it allow to apply for I485, and I-765 while I-360 is pending? And does it also means that the USCIS has the jurisdiction over AOS and work permit? I only understand that if it is administratively closed, the person will only be temporarily get off from court hearings while waiting for the decision of I-360...Thank you...

fajrakatana Immigration Judges upon request can administratively close removal proceeding to allow the case to be adjudicated by USCIS.In December 2012 The Board of Immigration Appeals (BIA) published an important decision regarding “administrative closure”.Keep in mind once the case is administratively closed the alien doesn't need to appear in court to attend removal hearings until the case is re-calendared for a new hearing. The case is closed temporarily until final adjudication of the case by Uscis.

"In determining whether administrative closure of proceedings is appropriate,

an Immigration Judge or the Board should weigh all relevant factors, including but not

limited to: (1) the reason administrative closure is sought; (2) the basis for any

opposition to administrative closure; (3) the likelihood the respondent will succeed

on any petition, application, or other action he or she is pursuing outside of removal

proceedings; (4) the anticipated duration of the closure; (5) the responsibility of either

party, if any, in contributing to any current or anticipated delay; and (6) the ultimate

outcome of removal proceedings (for example, termination of the proceedings or entry

of a removal order) when the case is recalendared before the Immigration Judge or the

appeal is reinstated before the Board".

Ohh I was getting so irritated because for some reason and of all days I couldn't find the forum thanks sandranj for your help.

This morning around 9 i got a text message saying my my case had updated. I was APPROVED guys. Thank you Jesus. To all those that was here with me on the journey you know yourselves thank you very much. it took them two weeks exact from when they got the rfe. You guys wEre the first on my mind to come share my joy with apart from God. To all those waiting your approval is coming trust in God. Am here if you have any questions my journey is not completely over yet.

Question someone??? After the vawa petition gets approved does the I-485 automatically become in process again?? Or does my lawyer need to let them know that my vawa got approved and to proceed with the I-485? And does anyone know how long it takes to get a decision . My lawyer hasn't said anything about me having to go to an interview.

If you've already filed the I-485 previously then you don't need to do anything after the I-360 is approved, they will eventually get to it. It can take several months after the I-360 approval, I believe, to get any movement on your I-485.

Hi Macbook: you are not alone, I am still here, I first applied my one on Jan22th 2011, then come back home to pick up birth certificate following NBC director's letter,after that my case has been updated to March 28th 2011,which has never been updated so far. I sent my e-request,computer said I have not yet reply my RFE before, i remember it was on Sep7th 2011,VSC sent it to my former apartment ,Obviously I never received it, I have to use my relative's address to receive it this time .Sandra said I need miracle to go through it,anyway, I am an engineer, i can wait , but i am not sure how long my drug addicted wife can wait, 2 years pass easy, i keep my first christian marriage for 4 years now .I tried all my way to find help from my state senators, got reference letters from my mentor and wedding pastor. I even sent my wife's crack smoking pictures to VSC email,I am not try to put my wife into hot water,I think she need go to rehab, since she still marry me,I will do good things to her.Actually after i see myjay and lionlion got denied, I know this is hard way to get greencard,still some victimes miss their good shots.even they denied us,give it another trial run, bring my wife to Auckland if she want, life is racing, anything before or after is just waiting.
