remember that (at every turn) you don't deal with "government". You deal with various "persons". One person will deny you, and with confident look and motive. Yet another person (fair hearing) will rule that Agency "shall review" your claim. Then also file complaints until the Agency complies with fair hearing ruling. If you manage to turn the tables, they'll end up paying more than you'd expected - just to make sure you've been satisfied

Sandraj, I applied for food stamps and i got denied twice due to im not a resident or non citizen how come they issue prima facie if i couldnt get any benefits?

Bless me first of all I am glad your lawyer finally realizeD she screwed up in your I-765.I am not convinced Uscis will change the category C31 to C9 just with her request,usually we submit a new I-765 but now let her fix it. It's a shame that your lawyer being an immigration lawyer doesnt know the basics things about Immigration Law,and you had to come to visa journey to learn and tell her the category she chose is for those with vawa approved.Regarding the food stamps a few States continue denying food stamp for alien using prima facie. YOU NEED TO GET UGGLY and then maybe they will listen you.Good luck.

Thanks singledad today Im going to ask for a hearing, if only i have a work permit i dont need food stamps . if only they knew its so hard to be in our position. Food stamps is a Big help for people trying to survive like me especially for those people who cannot work.

Sandraj, this is what she said in her mail yesterday:

if you would like to file a new I-765, the cost to the government is $380, if you don't file for the fee waiver.

I don't know if I haven't made myself clear, but I have had clients get their work permits in the same amount of time whether I used ©(31) or ©(9).  

I can write a letter to the Vermont Service Center to request the category be changed to c(9).  If you file a new I-765, they may not allow 2 applications for 1 VAWA application.  I'll send the letter today.

FILE VAWA SEPTEMBER 15/2011 GOT TWO PRIMA FACIE. TWO WORK PERMIT THEN I GOT APPROVAL ON DECEMBER 26. 2012 YAAA :dance:

APPRVAL AT 12:02PM THEN 12:04 TRANSFER TO BENEFITS CENTER THEN SAME DAY AT 3:06 THEY TRANSFER MY I-1485 TO MY LOCAL OFFICE ALL WITHIN HOURS WAITING FOR INTERVIEW APPOINTMENT YAAAAAAA :thumbs::dance: :dance:

Bless it's hard to believe what she is saying because category C31 is to get EAD after Vawa approval and I never saw or heard about any Vawa case approved in 3 months, did you? but C9 usually takes 3 months to be approved.It;s up to you.

I''m so confused .

My lawyer said that i have to file I360 first and when i get approval of I360, i can file i485,and i765.

I have been researching and some said i can file i360 along with i485&i765 since my abuser is USC..

I never filed i485 while i was with my husband.

Is it possible that i can get Working permit while my VAWA is pending or file them all together at the same time ?

I also tried to get food stamps and daycare I am in the state of Utah. And they denied me I called them and had my lawyer fax them the prima facie and stated I could get legal assistance. And they still denied me! I was frustrated....

Irara if you want to work you don't have to wait your Vawa approval to submit form I-765, you can file when you want, but to get work permit you must submit form I-485 along with form I-765 ok.Tell your lawyer to study a bit more about Immigration Law, but I think she should find another field,lol. It's unbeliavable how many lawyers do not know about Immigration Law and they insist to be an immigration attorney...geez.

Today i called my lawyer and said that i was told that i could file I765 before i get approved, and he sound like he was suprised....he said he's busy and told me he would call me back but he didnt ...

I'm gonna talk to him tomorrow about it

You are saying I can apply for work permit while my I360 for Vawa is pending if i file it with I485, am i correct ?

Am i eligible to file I485 without Vawa approval?

I dont have to file all three of them together ?

Sorry to bother..

Seems like my lawyer doesnt know #######. That makes me worry now :(
