Hi everyone I am new here I have been following for a long time but I wanted to jump in so I could share my experiences with everyone. I have gotten a lot of valuable info just by following this site. I just filed my paperwork last year in December and so the long journey begins. was a male victim which is in my opinion much harder to prove but included in my paper work was a copy of the approved I-130 that my ex-wife filed for me and which was approved to show her citizenship as I did not have a copy of her birth certificate, our marriage certificate, pictures of us together in different places/occasions, bank statements, utility bills under our name, car insurance paperwork with both our names, rental agreements, income tax returns for the last 4 years, health insurance, notarized letters from her mum and sister testifying to the validity of our marriage.i hope this will be enough to show a bonafide marriage. To show abuse I had a permanent restraining order, divorce complaint and decree, service event report showing how she tried to get me arrested by claiming that I had abused her when I hadn't, letter from my boss showing how she tried to get me fired and letter from psychologist showing the mental abuse I had undergone. We had been married for four years. On 12/27/2012 they sent me an rfe for police clearance which I resubmitted on 01/25/2013 so now it is just a matter of waiting. by the looks of things I don't think I ill get this issue resolved by mid 2014 judging by other people's timelines. Hey sandranj, I noticed that you have a lot of experience and valuable advice to everyone here please let me know what you thing about my evidence. thanks a lot

Dec 2012 filed I-130 together with supporting documentation through lawyer

12-27-2012 rfe for police clearance

01-26-2013 sent back reply for rfe

Bless me my EAD took about 3 months after applying I applied and August 2011 and received it the end of October 2011. So it does take about 60-90 days. Just try to be patient . After me not have the right to work ever that seemed so quick and I was so happy that it had been so quick! ?

Bless me I can't stand lawyers like yours that don't explain to their clients the right thing, of course he /she can file I-765 category 31 , but did he/she tell you that USCIS will issue your work permit just after your vawa approval using category 31? course not! she/he just said "you have to be patient", the right thing to say is "you will have your I-7651 category 31 approved when Uscis approve your Vawa, you have to wait 15/19 months, but if you want to work right now i can apply using category C9". If you need to work right away and your lawyer knows that then she/he did a bad job in your case already.

If you want to work right away you have to file I-765 category C9. In this thread most of people are working and with Vawa pending and they are working using category C9. People that said to their lawyers "I don't need or I don't to work now" then their lawyers filed I-765 using category 31. Akumu's lawyer filed using category C31 because he said he didn't have to work right now, then the lawyer filed using C31 and he is waiting almost 1 year for his work permit, and when his Vawa will bes approved he will have his work permit issued as well, but as said before most of people here are working using category C9 because they told their lawyers they need to work asap.

Samosa it seems you have enough proof showing bonafide marriage and abuse. I think you are good.

Yep I have some experience with Vawa cases. I am working with Vawa cases since 1994, and I became a lawyer 23 years ago, but I am not that old,I am 46 years old,LOL

Sandra, the 765 that you filed lately where they new cards or renewals? Do they speed up renewal cases compared to new cases. Did you file any new case betwwn end of Nov and December who have been approved already?

Bless me unfortunately you can't change now, you have to apply again, but then you have to wait again for 30/60/90 days, usually 60 days. Just call your lawyer tomorrow and tell her"

"There is a memorandum from Uscis stating that individual who files form I-765 category C31 will receive the work permit just after approval of form I-360, and the memorandum clearly states who have a pending I-360 and I-485 must file form I-765 category C9.I am sending you the memorandum and please let me know why you chose the category C31, because I can't wait my Vawa approval to work, it will take at least 16months for Uscis adjudicate my case. You told me to be patient, but you never told me they will issue my EAD just after approval of my Vawa case, but I have the option to have my work permit issued fast using category C9 since my husband is an US Citizen and I have a I-485 pending.I need to work right away. Please read page "3 (2) filling requirements.

http://www.uscis.gov/USCIS/Outreach/Feedback%20Opportunities/Draft%20Memorandum%20for%20Comment/VAWA-Authorized-EADs-PM.pdf

Bless me as you can see the memorandum clearly states category ©(31) should file their Form I-765 only after the approval of the Form I-360"

"...Additionally, eligible self petitioners currently available) may request an EAD under 8 CFR 274a.12©(9) by concurrently filing the Form I-765 along with the Form I-485 and Form I-360. However, self petitioners requesting an EAD under 8 CFR 274a.12©(14) pursuant to deferred action and self-petitioners requesting an EAD under 8 CFR 274a.12©(31) as provided by section 204(a)(1)(K) of the Act should file their Form I-765 only after the approval of the Form I-360".

Hi guys... my case is still the same. I've been waiting for my Congress person to help me but its been more than two weeks and im still not getting anywhere much with them. I just keep waiting and waiting.

Besides the abuse I suffered, this is one of the hardest things I've been through! I guess I can only come out stronger because I am already broken.

Keep the faith everyone.

That is a Very good point Sandraj!! My Lawyer asked me if i really Needed to Work ASAP to file for Me I-765 Work Permit but i told him i didnt need it that much coz am Still in School and the School provided me with what i needed..,and a Job in School too. So i guess he went ahead and filed my I-765 on Category C31 to wait until my Vawa is approved to get the Workpermit..
