domi-nique you would get a 10 year permanent green card, and you fall under the 3 year rule for naturalization ok, but when filing for naturalization I recommend you submit the Uscis memorandum stating that ok. I know two cases were denied because the immigration officers didn't know about the 3 years rule for Vawa.Only VAWA based application from spouse of USC are eligible to apply under 3 year rule. The law does not provide the 3 year rule to battered spouses/children of green card holders.

Folks i have some news.NBC since May 2012 was adjudicating some cases of I-485 for vawa filers,but now it's official NBC incorporated vawa I-485 applications from Vermont.They will perform inicial review,send RFE,making background checks etc but when the case is completed they will ship to the local office to attend interview. Despite they are adjudicating I-485 for vawa filers in Nebraska you should file form I-485 with Vermont.I am using my phone,sorry i mispeled some words.

Sandraj thanks for all the information and advise... Hope when I get home I got my RFE letter to see what they want from me ....

Once you submit the evidence requested and desicion is made you will be notified by mail..( really want positive desicion with or without interview soon )

Let's see how it goes only GOD can do everything... Thanks again, I will let you guys know .. Waiting and prying

cc198 usualy they ask "how did you meet your spouse"? "are you still living together" "Did you get divorced or not yet" etc. It's just basic things, they don't ask about the violence, and they ask to see the original documents that you submitted for your Vawa case.Take with you to attend the interview your passport, marriage certificate,your birth certificate and respective translation, divorce decree if you were married in the past etc.Just in case take with you documents about the abuse.

If all evidence was sent to VSC with A# do you think they will forward to the appropriate adjudicators if the VAWA file is in another state?

verysadguy Vawa cases are adjudicated JUST in Vermont. Nebraska is adjudicating form I-485 of Vawa filers.

Vawa Unit sends the file to Nebraska after Vawa approval, but the adjudicators of form I-485 cannot change the Vawa decision and they can't question about the abuse anymore.If some new proof or fact come up when attending the interview and they want to deny form I-485 then they must send the case back to Vermont stating the "new findings and reasons because they want to deny" and vawa unit will reaffirm the previous decision or deny the Vawa case.I heard just one or two cases of I-485 denied based in vawa, it's not common at all.

sissi10 is your case in Nebraska or in the NBC(national benefits center)?.I couldn't find your previous post where you mentioned that,anyway if your case is in the NBC you will wait for a few months to attend an interview in the local office, because NBC is working VERY slow.
