Survivor 2012,how do I know? because they touch the Vawa petition just twice, the first time when they receive the petition and to issue the prima facie and the second time to adjudicate, that's it!. When the adjudicator gets your case to adjudicate if he/she feels your case has everything to be approved they will approve without RFE, if he/she thinks there is no enough prove of bonafide marriage and/or violence, or the person forgot to submit some document then they will send an RFE.

Every time you apply for work permit and prima facie they won't go to your file and look everything all over, they just check their system(computer) and see if you qualify for Prima facie or work permit and they approve or not, but they touch the petition twice if there is no RFE. It's not common to Vawa Unit to send 2 RFEs, it happens just if the adjudicator forgot to ask something at the request.

Please if you have not already done so go to this link http://www.visajourney.com/news/ or check the news tab at the top of this page and sign the petition made by VAWA to hire more workers for the VSC as they are 12 months behind on the women filing for help. As of today there are only 43 signatures and the goal is 25000 by Jan. 21 2013.

Merry Christmas, Happy New Year to all been a lot going on here I have been reading but wasn't logged in forgot my password and was determined to remember it instead of changing it.......one thing that caught my eye was the congress issue, what is the status on Vawa as far as the White House is concern, are we left out in the cold?

Akumu you have a vawa pending then ICE does not have a reason to arrest you. You wont be out of status you have a pending vawa and it means you are authorized to stay until final decision of your case. Do not work without work permit because in case Uscis shows up where you work and find out That you do not have a work permit you will be in big trouble with immigration.

nardah everything is fine with Vawa. The changes proposed did not pass the house,the House Republicans have blocked the re-authorization of the Violence Against Women Act (VAWA) and then officially expired, but Vawa is in effect.

Ok great that is all fine, what were the changes they were proposing? I got scared for a min......is the funding affected in any way though?

i do not understand the purpose of hiring a lawyer when one still have to come to this forum to ask for help and guidance.SMH..

Please friends shake your lawyers really hard and be careful who you give your money to!!!!!

There are a lot of fraudsters out there willing to make you believe they are competent and experienced with VAWA cases, amongst others, whwn thet are NOT !

It is not about having a lawyer or not the main reason why people write in this forum. We are looking here for support and having other people going through the same situation and emotions that we experience. Also, we learn about each other experiences concerning the legal paperwork and our timelines. There is a great lawyer here with tons of experience in vawa cases: Sandra, she gives excellent advises and also support.

So please don't say that this forum is just for people with no lawyers, you can't say who deserves to be here and who dont, we are all in the same boat.

Hi everyone,

I first applied for Vawa a year ago.

I'm now on my third prima facie document. However this time, they only issued it for 60 days and they added the line "It is expected that a decision will be made within 150 days", Has anyone received a prima facie like this? Was a decision made leading up to the 150 days? ?

Sir charles few years ago Vawa Unit used to adjudicate Vawa cases in less than 150 days, because of that the prima facie states "It is expected that a decision will be made within 150 days" At present, Vawa Unit continues issuing the Notice with a validity period of 150 days, but when the Service is unable to complete the adjudication within the 150-day period, the alien can request an extension.I have several cases that they issued the first prima facie valid for 150 days, and the second prima facie is written ""It is expected that a decision will be made within 150 days",but they are waiting 14/17 months.
