Hey Sandraj. Thats good information. I showed my Lawyer the info you wrote down and he said its not the first time he has filed I-360 and I-765 together without I-485.He told me he has has experience of 27 years and his Clients get approved in I-765 and I-360 the same time. Then he helps them file I-485 next. He suggested that When he filed Both my i-360 and i-765 Same time Last year my case was both in Initial review and now they are in DECISION review. That they is a chance of Both of them getting approved the same time. Nways all i can do now is Hope all goes well.

I shouldnot be mean to you, actually it is my wife's own problem, she quit college the same year her dad got life sentence for his Seattle cop killing crime. it was 9 yrs ago, then she became victim of drug due to her bad friend, called diana, a girl whose boy friends are drug dealers in Seattle infamous "Rainer Ave".

my pastor Zeta told me it is not a easy job to convert those drug people go back normal life, she dealed with those kind of people for 20 yrs. anyway, I work and make money, I will never give my money to my wife's drug habits, but i can feed her and take care of her two younger sisters and my mother-in-law, they are all living under poverty line, I will support them as long as i am still alive, they can come to New Zealand if they want.

I donot care about US greencard, if I make my first million dollars, I would rather go to America using the front door, be a nobel middle class American. not begging here for other people's sympathy. I donot want put my life on other people's hands, instead I want to control it. It is my Life! thanks

akumu what your lawyer did is not wrong but you could not get your EAD like everyone here that didn't file form I-765 yet.Of course when your I-360 is approved your I-765 will be approved.I just don't want that people reading your post and think" oh I can file I-765 with I-360 without I-485 and get work permit now". No, they can't, they will be able to get their EAD when their I-360 is approved or if they submit I-485 along with form I-360,if they need to work asap then they have to file form I-485 to have their work permit in 30/60 days.

Your case is for decision, it means you submitted your case at least 13/14 months ago right? as I said everyone here that didn't file form I-765 along with I-360 have the same case like you, they can't work now, but when they have their I-360 approved they will be able to get their EAD.

I just want to make clear for people reading here that if you they need to work right away you have to file form I-485 along with I-360, but if you don't have to work or don't want to risk to have Vawa denied then they will have the work permit after 14/16/18months . When your vawa will be approved your work permit will be approved like everyone that didn't file I-765 yet, they just need to submit after vawa approval the request, but you have to wait at least 14 months to be able to get work permit if you don't file form I-485, lately the timeline is 18 months.

Very good point there Sandraj!! I wasnt in a hurry of getting the work permit coz i came here in U.S with Student Visa and the School assisted me with getting Social Security and I.D, am working well without any problem. Two years after coming to U.S i got Married to this Lady who abused me so bad and that is when i filed for VAWA. Even my lawyer told me i dont really need to use Prime Facie for public benefits coz i make enough to support myself.!! Sandraj..- Can ICE arrest a Victim of Vawa who has a pending case with Immigration?

Akumu they can arrest if they can't find right away in their system the person has a pending Vawa, but if they check and confirm the person has a pending vawa they won't arrest the person at all, but of course if the Vawa filer is doing something wrong such as drinking and driving ,using drugs etc.they will arrest even with vawa pending.

You said you are working, you can't work without a work permit,it's against the Law!you can have a big problem with uscis if they find out.You are allowed to work in the campus of the university without EAD , besides that you need a work permit ok.

Hi sandranj l just recieved my 4th PF and it says "it is expected that a final decision will be made in this case before the end of 150 days.in afew cases the adjudication may not ne completed in this time frame"

what do you think?l hope its just a decision without any rfe.

Missymd theY didnt touch your case to adjudicate it means you stil can receive an RFE.You asked to renew the prima facie and they renewed but they didn't start adjudicating your case yet.When they touch they will approve or send an RFE.

How do you know they started adjudicating your case?

11/14/2012: I-360, I-485, I-765 filed.
11/15/2012: VSC received.
11/19/2012: Receipt notice for I-360, I-485, and I-765. (All fees waived).
11/26/2012: Biometric appointment notice for 12/14/2012
11/28/2012: EAD approved. Card sent. Yay!!!
11/30/2012: EAD card arrived. Went back to my job smile.png
12/14/2012: Biometrics taken. Easy process.
12/15/2012: RFE for good moral character. (Initially sent city police clearance.)
12/16/2012: Replied RFE for good moral character with state-wide police clearance.
12/20/2012: VSC received RFE reply. Case status: RFE response review.
01/02/2013: Prima Facie determination established.
01/07/2013: Prima Facie received in hand (hard copy).
08/06/2013: I-360 APPROVED!!!! Heck yeah!!!!

Now waiting for my turn to go to the GC interview :) Wish me luck!
