akumu I got it now how your lawyer handled your case, he filed I-360 and I-765 along long time ago, of course after many months you still waiting for your work permit, because you don't have form I-485 pending and Uscis didnt issue your work permit.Now your case is for decision then if Uscis approve your case they will issue your permit of course, but the lawyer doesn't know if Uscis will approve with deferred action or not and then the category for EAD will be diferent, because of that every single lawyer that i know wait for the Vawa decision and then file form I-765 if the alien doesn't want to file I-485 together, as i said we don't know if the case will be deferred action or not and then the category will be different, but what I said before prevail, nobody can't get EAD without pending I-485 or sending along with form I-360.

Hi Sandraj....My lawyer said I am eligible for fees waiver, but since they are charging me hourly, its not worth the money, because in preparing the form for fees waiver will just add up and I need extensive proof in order for me to qualify. So probably I will not waive the fees. The lawyer also said they will not file my son's adjustment status for now, they will just wait for my I-360 to be adjudicated. They will only file my adjustment status since in order for me to get a working permit. Do u think this is the best idea, that my son will just file his adjustment status later on?

In part 4 of the I-360 they still insist that its Manila, Philippines,that is the consulate I would go, if I could not file AOS in the US..Thank you!

Loveme I asked myself this question several times and I still don't have the answer.I never had or heard any case of AOS for vawa filer without interview,but her case was approved without interview.We were damn surprised. It was a normal Vawa with 86 pages.My vawa cases are big,lol.She had a police report,hospital records, restraining order and pictures of the violence,but I filed hundreds of cases like her case and they had AOS interview,maybe because she is a pastor they considered her story and proof without any doubt (???).We know Uscis accepts affidavits and reference letters from Pastor,Priest,Iman,Minister etc as a proof of good moral character, it means their words have some special consideration right,maybe they decided to approve because of that, but I can't tell you for sure the reason because I don't know the reason.

Sandra Can u please let me know more about the case AOS was approved without interview.. I heard that by law you need to get an interview in order for an individual get green card...

Loveme you asked if I contact my congressman .. Yes I did it.. They helped me to get my I 360 approval even if it took 14 months .. Then after I told them about my AOS, congressman office said they called USCIS and make inquiry about my case... And now they transfer my case but I thought it was transfer to my local office for interview but let see how it goes .. In GOD's name everything is possible...

I emailed my congress person. I have not gotten a response. I guess i better call them tomorrow. Maybe that will be better than emailing. How did u first contacted them? Email or Phone? Did they very willing to help? or did it take a lot of begging/asking

Hi Sandraj, thank you for trying to help me. My lawyer had failed me in some ways but I really need to have my papers done, that is why I'm getting opinions here so more or less I understand how the process goes. Anyway, do u have any idea where I can get that finger print card that I need for my police clearance? The police dept here on my area does not supply that card, so I have to bring it my own. I know the link wherein I could print out the card, but I don't have any paper that is just like a cardboard type of paper. Thank you.

Loveme You have to Call the congresman office.. They gonna send you a release form that u have to sign.. Then they email USCIS with inquiry about your case then congresman office let you know about what USCIS says ..

love me the congress person doesn't give hard time at all , but he/she takes a while to call you back, it's like they forget you for a while, because Uscis use to answer them in 48 hours.I use to contact them by phone first and then sign the form to release the informations.

fajrakatana your Consulate provides the Fingerprint Card, they are authorized by the NBI to take fingerprint impressions.

What I need to get is clearance from the Washington State Patrol. And I will get finger prints done at local police department, but they are not supplying the CARD I have to bring my own finger print card. And what do u think I would put as the purpose of obtaining the finger prints? Do I have to write down for Immigration purposes? Thank you!
