survivor2012 I own a non profit organization who helps victim of domestic violence and I am an advocate for victims of domestic violence almost 15 years,plus 22 years working as an attorney. Everything i posted here is not a copy and paste like you said from wikipedia, but years of experience, but as I said before I don't know and you don't know what's gonna happen with Vawa then let's keep civilized ok, and do not bother to answer me more because arrogant people like you i am sick and tired to handle it and I really don't need a new one. You are you wasting your time attacking me and I am helping others, can you see the difference?...course not.

What's with the harsh language? I only wanted to state the truth, didn't mean to attack anyone. I'm also trying to help people who are helping me. We're here to help each other. I just wanted to speak from what I learned. Don't take everything too personally like that. I think sometimes even if you don't know, that doesn't mean nobody else knows, even if you had tons of experience (I never doubt that). I just happened to be in the right place at the right time. I was the Congress correspondent for a D.C. station, that's all.

11/14/2012: I-360, I-485, I-765 filed.
11/15/2012: VSC received.
11/19/2012: Receipt notice for I-360, I-485, and I-765. (All fees waived).
11/26/2012: Biometric appointment notice for 12/14/2012
11/28/2012: EAD approved. Card sent. Yay!!!
11/30/2012: EAD card arrived. Went back to my job smile.png
12/14/2012: Biometrics taken. Easy process.
12/15/2012: RFE for good moral character. (Initially sent city police clearance.)
12/16/2012: Replied RFE for good moral character with state-wide police clearance.
12/20/2012: VSC received RFE reply. Case status: RFE response review.
01/02/2013: Prima Facie determination established.
01/07/2013: Prima Facie received in hand (hard copy).
08/06/2013: I-360 APPROVED!!!! Heck yeah!!!!

Now waiting for my turn to go to the GC interview :) Wish me luck!

i got an RFE for marriage in good faith,i didnt have any utility bills to send,but i found bills of some call card we used together too,i also called the tax office give me a copy of the taxes we filled that yr.i got my bank statement containing our address,notarized affidavit from friends and family,and personal affidavit,mails containing our address and also showing that i changed my last name to his.

Congratulations timartinez how did u find out ur approval by mail or your lawyer or you see it online on case status.

And did u apply for aos or no with a lawyer or flying solo.

I've been reading this post for about 3 days now. And I wanted to share my story and the process I've gone through so far. My husband had first filed I-130 when I was pregnant with my youngest daughter. We got married when we were 18 and have 2 kids being so young we had a lot of fights tht my parents witness and that my oldest son would start to mention I had bruises multiple times and things broken all over the house . He then left me and I was so depressed because of everything that had happened. I then applied for the VAWA 8/11 I received my workers permit 3 months later and did my biometrics. I have renewed my workers permit once and my prima also once. I received a paper saying they needed more info so I had to file more RFE. My lawyer is in the process of doing tht now I keep waiting for more info I'm just like all you guys here playing the waiting game. I hope I get approved so I can finally get a career and give my baby's a better future!

My lawyer made a mistake and according to immigration me and my husband didn't start living together right away so I had to get papers and pictures and letters from people that proved and stated we started living together right after marriage.

Hi ...

I am applying for my petition next week. Wish me luck.I did hire a lawyer but i feel he is not too competent in these cases. I called him to check on the failure of re authorization of Vawa and he doesnt have a clue.

As far as i have read the threads i know for Vawa Application the officer adjudicate on three main basis .

1. Abuse ( physical or mental)

2. Bonafide marriage

3. Good moral character.

I have read all the posts of Sandraj and i feel she posses a lot of knowledge about these petitions. I would really appreciate her and everyone on this thread to guide me through these rough times.

Now for abuse part there has been many instances of physical abuse but i do not have a police report. however my friends are ready to testify that they witnessed the abuse.i am sending three different people's statements testifying that.

Moral character i am enclosing the local police report , police character letter from my home country and statements from my friends.

Now for bonafide marriage , we stayed at our inlaws house nad do not have any utility bill. However we had a bank account , his car insurancegere my name is included.photographs and one of the cell phone bill. he worked part time and has never filed taxes. i do not understand what else shall i include .

please advise . i understand as you never know what adjudicator is going to decide but there must be some basics things that look at.

nids do you have a restraining order against him?. It's not mandatory to have a police report and/or a restraining order, but Vawa cases became tough lately and if you can't show proof of the abuse suffered your chances decrease a lot, it helps a little bit affidavits from friends but it's not enough at all. You need to write down an amazing affidavit stating all violence suffered ok.

Did you have some counseling? you should find some organization who helps victims of violence domestic and they might help you with some counseling/therapy and it can help your case a bit. Did you spend it any time in a shelter?

Do not forget to submit along with form I-360 proof of your husband status( Us.citizen or green card holder).

I do not have a restraining order against him.I am sending his Birth certificate as you advised.i did my sessions with the psychiatrist and has their evaluation report which i will be sending.I have drafted my declaration and would like to send it to you if you allow me so that you read it and advise me further an dthat way you will know my whole history too to guide me better.

Why are trying to prove hardship? You have to prove you were battered or suffered extreme cruelty, that is it. Extreme hardship is required in VAWA cancellation of removal(CoR), it means for those in removal proceedings and filing Cancelation of removal. For hardship allegation the individual must establish to the immigration judge the impact of the loss of access to the U.S. courts and criminal justice system regarding child support, alimony, child custody; enforce orders of protection and/or criminal investigations; the individual won’t have adequate medical attention due a serious illness or mental health treatment in the Home Country, and proof the treatment the individual is receiving in the USA is not available or inexistent in the home Country etc, but as I said you are not in removal proceedings right? then you don’t have to argue and/or prove extreme hardship.

The time of your marriage won’t affect your case at all. I had one case the girl lived with her husband just 23 days and her case was approved

Hey Sandranj that was very helpful. It makes me feel a little relieved. No wonder my lawyer didn't tell me to prove this factor. I'm not in removal proceeding. I have never been illegal or out of status. I had all proofs of battery and such (psychiatrist paper, doctor's evaluation, tests, treatments, and roommates' statement). Luckily prior to me ever thinking of leaving him (about 8-9 months ago), one time he pushed me down the stairs, my ankle was fractured and when we went to the student health center for an X-ray I did mention that he pushed me down. They got that recorded also. The incident was never reported to the police though, but I don't think it needs to be. I'm just anxious about how evidences are being interpreted in Vermont. I guess I have to wait and see. Thank you so much for clarification on it. I really appreciate it.
