Survivor2012 welcome to vj.that was really helpful.thanks..l feel bad for the native americans.this land belongs to them yet they continue to suffer like us immigrants..Oh by the way Sandranj is a lawyer and she has helped so many people on this site.she,ll be glad to answer your question if you need help.

Missynd the HOuse said the bill was to supportive of immigrants and LGbT community and then they let the Vawa Law expired rather then approve the changes proposed.We don't know yet how Uscis will proceed regarding all vawa cases filed.There are proponents already working to revive the law including Senator Murray.They have to count on the new congress to approve tho, but they have to start from scratch.Uscis maybe will put it on hold vawa cases waiting a new law,so far we can't confirm anything because Uscis is still silent regarding this matter.

I am new to this forum. so need help on a question.

I am filling my Vawa Petition this week. I know there is no fee for filling VAwa petition but i am filling my I-485 and I-765 along with vawa peition. I am not asking for a fee waiver on I 485 and I 760. Kindlky advise me what will be total fee to send with my application.

Survivor2012 you have a strong case.It's a shame they did not prossecute your husband,but for vawa purpose he doest need to have a sentence it's necessary that you show you were battered. You have good proof of the violence suffered and bonafide marriage.As i said before we don't know anything how Uscis will react because Vawa Law expired.Since 1994 they passed the law 3 times but for the first time Vawa did not pass the House. I believe they will revive the law soon.

survivor I won't discuss with you. I have 22 years of experience working as a lawyer and I am member of the visa journey almost 8 years, then please go to a law school and come back to discuss with me.I filed over 6.000 Vawa cases since 1994.

I stated here at least 10 times that NOBODY knows what holds the future for vawa filers.NO ONE, not even me or you, because of that do not come here to attack me. I am doing right now more than 20 pro bono vawa cases for members of this thread , and filed pro bono more than 80 vawa just for member os the visa journey in the past 8 years, then do not come here to tell me to be careful with my thoughts.

Nids l guess you can still file.if they dont accept new applications then l guess they will send it back.and if they accept it,expect to wait upto 19.1months.thats the processing time now.i,ve been waiting for 15months.

VAWA reauthorisation failing to to pass means that the law has (for now) reverted to the 1994 version (originally authored by current Vice President Joe Biden).

For the most part this means that many of the programs that the actual Violence Against Women Act helps to fund (such as rape clinics, shelters, counselling, etc.) will no longer receive those monies until the reauthorisation is passed by the 113th Congress.

The re-authorisation bill not being passed has no effect on any pending or future VAWA cases that someone wishes to file. If you had a VAWA case before 31st December 2012 then you still have a VAWA case on 1st January 2013 and can still file it.

My lawyer also said I had a strong case, but we never know how people at Vermont are. I'm worried to death everyday. My husband threatened to report me to ICE all the time (I had text message/emails that he sent to me saying that). What I'm worried the most about my case was whether or not it satisfied the factor of "extreme hardship". I was mid-way through my MBA degree and because he stalked me, I had to quit. Depression and anxiety were big factors that contributed to it also. I only said that I wanted to continue treatment with my condition, and to continue school. Is that enough for "extreme hardship"? Also, we dated for a year before getting married, lived together for about 8 months, but we were only married for 5 months before I can't take the abuse anymore. Would the short time of marriage affect my case? I've been in the States for 8 years. I came here in 2005, didn't know him until 2010. I left him in July 2012, thinking I could just try to continue school and work, and hopefully time will heal, but ended up having to quit. I fell into despair until my shelter advocate where I stayed at said that I could apply for VAWA. I've never heard of it, but I was willing to fight my way back to happiness. I did everything they asked me to do, and I was still in F-1 status, never been illegal/violate any immigration law. Please let me know if any of those things would affect/delay my case.

I wanted to give up so many times, but my husband already told the authorities in Vietnam that I am joining some anti-government force in the States so I was scared to go home. He has family in Vietnam that would go to my mom's house to threaten her. He used to use that as a mean to make me stay with him. My lawyer said this wasn't sufficient proof because it happened in Vietnam so we didn't submit. I want to go home and visit her so badly but I couldn't because of my status. My mom had to move away so they can't threaten her anymore.

I'm working at a news station now, and I've been researching for the past 3 months about VAWA law, talked to several Senators and Congress members about it. From what I heard, they are bringing it up this 113th Congress, and for now VAWA will continue its 2005 legislation. You can go into 4vawa.org to learn more. I'd trust them more. Most articles, even in NYTimes, the people who write about it don't have enough knowledge to understand everything clearly. Comparing legislatures and journalists who rush for deadlines all the time, there will be misinterpretation. I didn't mean to offend, just that I've been a journalist for a while and I think wordings are very important.

I know it sounds stupid. No one could have thought that I would be a victim of DV. I felt so humiliated. I didn't even know he was a USC until way later into dating. We were fine until we started living together. At first I had a hard time talking to anybody about it (except roommates who witnessed the abuse almost everyday). I thought I could smooth things out in a civil,educated way, but I guess it wasn't anything that talking can solve. I don't know, maybe I'm just here to rant about my life. It makes me feel better. I stare at people's timeline hoping to find something that's close to mine, but I think everyone's case is different.

11/14/2012: I-360, I-485, I-765 filed.
11/15/2012: VSC received.
11/19/2012: Receipt notice for I-360, I-485, and I-765. (All fees waived).
11/26/2012: Biometric appointment notice for 12/14/2012
11/28/2012: EAD approved. Card sent. Yay!!!
11/30/2012: EAD card arrived. Went back to my job smile.png
12/14/2012: Biometrics taken. Easy process.
12/15/2012: RFE for good moral character. (Initially sent city police clearance.)
12/16/2012: Replied RFE for good moral character with state-wide police clearance.
12/20/2012: VSC received RFE reply. Case status: RFE response review.
01/02/2013: Prima Facie determination established.
01/07/2013: Prima Facie received in hand (hard copy).
08/06/2013: I-360 APPROVED!!!! Heck yeah!!!!

Now waiting for my turn to go to the GC interview :) Wish me luck!
