Jesse007 the main problem here is that you dont have a case number yet then you can't submit an e-request ,contact your congress person or email the UscIs ombudsman. If you set up an appointment with infopass they won't be able to help you at all because the information they have in their system is the same you have now I mean none. You just need to keep caling and calling until they return your phone calls.

Has anyone flown within the states whilst they have a VAWA application freshly mailed? Im trying to get mine out as soon as possible, but with everything that has happened, a friend has offered for me to spend christmas with them, something I would very much like to do, but its the other side of the country. I really don't fancy sitting alone on christmas day, eating tinned tomato soup.

Is it possible to fly within the states before getting any notices regarding the VAWA, or if I haven't mailed the package off by then?

Thanks!

Dewave if something is missing in your case they will send you an RFE anyway, they don't refuse your case. You must submit Police certificate, proof of her status(copy of her passport or copy of her birth certificate), proof of the abuse and proof of a bonafide marriage. As soon they have these things they will issue a prima facie.USCIS WILL NOT call your wife to attend any interview or make any phone to talk to her ok. She may send it some nasty letters or documents to USCIS and sometimes they put together with the Vawa filer file ,but they will considerate your proof not her statement.

Vawa Unit will adjudicate your form I-360 WITHOUT INTERVIEW, they are immigration officers, and once they approved your case you will have to attend your adjustment of status interview with immigration if you are not in removal proceedings, if you are in removal proceedings as soon your vawa is approved your lawyer should ask immigration to close administratively your proceedings and then the judge will send out your case to be adjudicated by USCIS;if you have been present physically in the United States for three years before applying form I-360 then you are eligible to apply directly with the Immigration Court for CANCELATION OF REMOVAL.You have to discuss this things with your lawyer. Once your vawa is approved I recommend to ask the Court to close your case, not terminate just to close, and then you will have your AOS adjudicate by USCIS.

I've only just read this reply, sorry for dragging it back up. I guess im just shocked. Shocked that they don't do any sort of interview with the abusive party. I guess some part of me hoped that if my wife was interviewed or something, see would take responsibility for what she had done, or when my statement was read to her, someone would be at least be able to see the guilt on her face. I dont know, not really sure what I was hoping for. But seeing as I will probably never talk to or see her again, I guess I was hoping someone would see her guilt you know.

It seems like it just leaves the door open a little bit for people to just write anything in their personal statement (If they were being dishonest I mean about applying for VAWA). I thought it was something that would be more looked into, if it was more emotional abuse as oppose to physical...but I guess...If they were to interview her, she would most likely just deny it anyway, so maybe there isnt much use in it.

I dunno, I'm just feeling so sad at the moment, I think with the holidays coming up, its just making me feel extra lonely now all of this is happening :(

This is an abuser! He is one of the examples which this country fails to stop! Violence! Just look at how many applications for VAWA every month, every year and yet the-what-so-called Law is worthless for it not strong enough or strict or firm enough to stop violence!

Freedom is given to wrong people! While others are stuck and suffered from those abusive behaviors!

Lord please help us all! This must be ended! Something must be done!

For example, many abusers are free of charge against them where they keep on hurting, abusing others and nothing stops them yet at the same time victims are sufferred by their heartless behaviors and waiting to have their application approved to get a job to make end meet.

What's wrong with the Laws? With the enforcement?

deawave2 you are good go to travel and have fun, just do not leave the USA. Because of the holidays sometimes we have some extra immigration officers even stopping people inside of the USA, it's very rare but it happens sometimes, just have your AOS letter interview with you and in case someone questions you just say you have an AOS interview scheduled and that is it, no need to give any explanation about Vawa blah blah blah.
