RFE means someone is looking at your case which is good.

has anyone been aproved without any RFE?

I am 18 months one touch couple of prima facies thats it?

I was approved without an RFE, along with several others earlier. You should be hearing something from them very soon. When does your most recent prima facie expire?

July 2011 - Applied for VAWA with I-765 and I-485 with fee waivers - receipt date Aug 4, 2011
August 10th 2011 - Received NOA's for all 3, fee waivers accepted
August 26th 2011 - Received EAD
Early July 2012 - Re-applied for EAD based on pending I-485
Mid July 2012 - Received NOA for 2nd EAD
August 1st 2012 - Received EAD
Silence for a few more months
October 26th 2012 - I-360 approval
November 19th '12 - Case transferred
May 2013 - Received interview notice

June 2013 - Interview (approved)

Someone asked me how to contact the congressperson. I don't remember who asked me that,well you just need to find out in your State who is your congress person and call their office and tell them you have a case filed with USCiS and because of their delay adjudicating your case you need his or her help.They will contact USCIS on your behalf inquiring about your case.They answer the congressperson back in 48 hours.

By what you are saying the 'processing time "guideline is faulty as best....

they have been "processing june 2011" for the longest but you applied in august 2011 :huh:

i am kinda glad they are moving faster than their website shows.

It definitely is. Several people who filed in July and August have received approvals or RFE's. Those that received RFE's probably just have a thing or two missing, but otherwise they were ready to adjudicate. So if the VAWA adjudicator gets to your file, sees the pattern, and enough proofs - they approve. Otherwise, they send an RFE. From prior posters it seems they've been taking less than 45 days to adjudicate after receiving the RFE response.

no RFE, I applied in June of 2011, getting by now has been so hard,

Dewave2 you MUST attend your AOS interview.They will give you 30 days to show them the prima facie,they don't care about Usps receipt but about having the prima facie to show them. Here is a problem the prima facie takes 20/25 to be issued and they won't give one day extra.It will be 30 days to send it the prima facie to the local office. Bring with you documents proving the abuse and they will give you 30 days.

You're completely right, I definitely need to attend the interview, I have no choice as I need to do what I can to keep my I-485 active. That's my concern though, is that I won't have enough time to get the filing together, from the day of the interview plus 30 days, I don;'t know if I'm going to be able to have all the evidence together, and send and received the Prima Facie within 30 days. Is it wise to try and reschedule that interview? After meeting with a lawyer yesterday (Which just confused me a little more) They advised actually going down to the actual office my interview will be at, and explaining everything to a supervisor, to see what they suggest. Has anyone done this?

Ideally, if I could delay the interview for like 3-4 weeks, that would give me enough time to do absolutely everything needed I think. I just don't know if and how thats possible.

That's weird. You should have received an answer to your request for prima facie extension. I think you should write a letter to Vermont asking about the status of your case, and re-requesting extension of prima facie. Another forum member, inpeace, did that when he got out of processing time and he got his approval.

I'm waiting for my AOS interview. My I-360 was approved in October.

So, lately not a lot of good news has been coming my way, so I thought Id share the little that has.

I had a job offer yesterday, for a position that starts January 15th, which is fantastic.

I also had a second interview for another job that I really want, so hopefully that will go well too, and I have my fingers crossed that they get back to me too.

And finally, I had a lawyer reach out to me, to offer his services for my case, and allow me to start paying him back in arrears once I start work next month. (I met with him yesterday, and although I don't think he specialises in VAWA cases, and some of the info he gave me kinda contradicted a lot of what Ive been told. I know having him on boarrd should provide some amount of help!).

So now, just trying to get my package ready as soon as possible to send off, hopefully before my interview next week!

AOS Journey

Dewave2 I answered your PM, your lawyer doesn't know Vawa cases, stay away from him, he gave you wrong informations.You can file I-360 and you can still use form I-485 filed before. Your wife withdrew form I-360 and I-130, but not form I-485 because she can't withdraw form I-485 just I-130 and I-864, your I-485 is still valid.

dominique something is wrong with your case, usually they renew the prima facie in 20/ 30 days. CALL THEM.

Congratulations on the job offer. I hope the second one works out for you as well.

If the info the lawyer is giving you contradicts with what you've been told here and your research, do NOT give him your business. There's another forum member who had to do almost everything herself because her lawyer knows little about VAWA, and is keeping her stuff hostage because of money. You don't want to be in that position. Have you tried Catholic Charities?

Truth is, you can represent yourself. There are some older members who did that, and had their cases approved. Sandranj has been extremely helpful in answering questions, and the rest of us can provide our experiences, links, news, etc that you can use to file yourself.

You should go for the interview with your I-360 filled out, and the attachments you have. You can write a letter stating that you are a victim of domestic violence and attach your police report. In the letter request a stay of adjudication on your I-485 and allow USCIS, not the Immigration Court to adjudicate your cases. This will give you time to file the I-360 and a new I-485. Then when you receive your notice of action on the I-360 (or prima facie, or both), you can take it back to your local USCIS office and give the IO a copy.

Sandranj what do you think? Should he request that they hold on to his old I-485 until the I-360 is adjudicated, or should he file a new one?

That same thing happened to me I sent in letter for extension mid October didn't get anything after two weeks so I called every two weeks till end I'd November and first week in December I got an rfe and the prima facie came two days later. Hopefully the same will happen to u or y just get your approval. I applied august 2011. Are u out of processing time? Good luck with everything

jesse 007 you can change mailing address but the chande they update your address is bad.I am sick and tired to see people filing out form AR11 changing their address and they kept sending mail to the old address,just yesterday I had 2 cases like that.When you move to a different address despite sending AR11, I advise to send it at least 2 letters and to call them to make sure they updated.It's a mess when you move tho.Jesse007 call Vawa unit again, each 5 days call them! Give them 15 days and if you do not receive the prima facie in 15 days then you have to contact your congress person to help you with that.

It is totally free you need to find out who is the congress person for Where u live in WA. They should tell you to come in and bring your approval notice and they will write a letter to vsc or your local office about your case. I did call mine cause my case was 14 months and waiting they told me come in with my prima facie and they will write vsc. They told me it usually takes about a month to hear back from them. I never ended up going I just got an RFE and working on it. Good luck hope that helps

believe he doesn't need to file I-485 again.He submitted form I-485 in the past and his form I-485 is valid. Most of the ex wife withdraw the application after the couple separate, but they can just withdraw forms I-130 and I-864 ,the I-485 they can't withdraw. The USCIS adjudicator will ask him to mail or bring the prima facie in 30 days. They do not accept just the mail receipt as a prove that the Vawa was filed, they want to see the prima facie. Dewave2 must attend the interview and ask them 30 days to submit the prima facie, usually the adjudicator says that you have 30 days.For some reason if the adjudicator doesn't want to hold form I-485 and want to deny the case he can ask to speak with the supervisor, but all cases that I know they gave 30 days.

Hi jesse007:first you need send your email to washington state governor, she is very nice, i am sure she will refer you to senator patty and maria, then following this connection, I believe maria and patty will help you, just tell them the truth on your life and what is your current situation, they will email you and let you sign their form to contact VSC, they will contact VSC for you, I am sure about that, they are very nice people. Good luck.

I also think you need find some experienced attorney, they will help you go through this vawa journey.

my case is in mess, last week my mentor found me one Seattle attorney, i hope I can survive my vawa eventually. I hope everyone here got their vawa approved next year, hopeful 2013.
