A year? Well thats that idea out of the window! Thank you for the heads up!! Im going to have to look at other ways to try and get the documents I need!

Send them copies of those NOA's you've received, the biometrics letter, interview letter, etc... Everything you've received from USCIS about your previous AOS filing. They sent you the biometrics letter, and approved the EAD request based on your wife's status as a US Citizen. If they needed proof of her status you would have gotten a Request for Initial Evidence. But that was provided so you can piggyback on the documents you sent previously. Do you have a copy of the forms you filed? i.e. The I-130 and I-485?

Love me Uscis cannot deny the Aos after the vawa approval , but if a new information or proof come up and you never told them about it then just in this case they can deny the AOS. For example the petitioner before having the vawa approved got marriage and uscis didnt know about it well they will deny the AOS once nobody can get married before the vawa decision,or in the interview the petitioner say she or he is reunited with the abuser then uscis may deny the AOS case. THey won't deny right away they must submit to vawa unit to review the new information obtained.If you dont have any news or anything hidden in your case they can't adjudicate again your case.

Yes I have copies of all the forms. All the forms ETC are still all on my computer. The only things I dont have, is anything I took a photocopy of, as I just took the photocopies needed, as oppose to scanning them in. I have copies of all NOAs and my Biometrics letter, so I will definitely include all of those!

AOS Journey

Day 0 - 07/10/2012 - AOS package (I-130,I-485, I-175) mailed to Chicago with FedEx.

Day 1 - 07/11/2012 - Confirmation from FedEx that package arrived and was signed for.

Day 3 - 07/13/2012 - Text confirmation from USCIS of receipt.

Day 4 - 07/14/2012 - Online banking shows that cheques were cashed.

Day 9 - 07/19/2012 - Received 3 out of 3 NOA letters in the post.

Day 11 - 07/21/2012 - Received biometrics appointment letter, appointed set for 08/07/2012.

Day 16 - 07/26/2012 - Completed biometrics walk in.

Day 56 - 09/04/2012 - Received text notification to state that my EAD has been ordered into production.

Day 59 - 09/07/2012 - Received 2nd text notification to state that my EAD has been ordered into production.

Day 62 - 09/10/2012 - Text notification that EAD has been mailed.

Day 64 - 09/12/2012 - EAD received in the mail.

I thought this was kind of possible, due to some information as part of an extremely helpful guide that IO have been using to bring the package together.

On page 21, it mentions the following:

The Freedom of Information Act (FOIA)

This law permits self-petitioners to view their own immigration files, if any exist. If the

abuser has already started the petition process for the self-petitioner, the documents that

self-petitioners get from a FOIA request may verify not only the marriage, but also the

abuser's immigration status. Self-petitioners who suspect that papers have been filed by

their abusers on their behalf should follow the procedure explained in Appendix 11.

It also shows reference to form: G-369

Am I just reading this completely wrong, with regards to accessing the paperwork filed?

If your wife was born in the US, you may be able to get her birth certificate from the County (according to page 18 of the ILRC pdf you posted above).

Have anyone ever heard of a i485 been denied after vawa approval ... just wondering if that could happen

Dewave2 i answered your question regarding what you asked me, but what do you need copy of her birth certificate. DID you file Vawa?.I can't remember all cases,IF YOU NEED TO FILE VAWA. Then you can ask vawa unit to check your AOS file, but if you need a copy for other reason they won't give you and you have to file the form that i said before. If the reason is to file I-765 or I-360 ask them to check your Aos file, and sit to wait.

Thanks for answering my question. I haven't filed my VAWA yet, no. I'm getting everything ready to file. So I can attach something in my VAWA package, asking them to look at my AOS file, to see all the evidence we attached as proof of bona fide marriage? I don't need copies for anything else, its just for the VAWA package. I luckily have proof of her citizenship as I had her birth certificate and her passport scanned into my computer.

That's really great man..I, on the otherhand, didn't have an access to her passport and her naturalization to proof her citizen.

Because of that It's been 2 months+ since I sent my package and they never give me NOA nor Prima Facie.

Even though I have her SSN and Driver License copy..I did ask them to look up her status for me..

But since October 4 2012, I never get anything from them..try email, phone call, follow up letter.

I barely have food to eat..at this point I can't apply for work permit either since I haven't got the NOA yet.

Hey everything will will work out for you keep praying maybe its taking them some time to look it up. Who knows with vsc. Just be patient easier said than done i for sure have learnt it through this process. 15 months of wait and just got RFE am trying to gather things to send it in. So just put God first

Dewave2 we go back to square one.You just can ask vawa unit to check her status they won't look your AOs file to gather the bonafide marriage evidences at all.They are in Vermont in a special unit and your AOS probably is in the local or district office.They dont have access to your file.When the person doesn't have a copy of the abuser birth certificate or passport then vawa unit call the local office to confirm if the abuser is american or LPr.You can ask them to check your file to see the evidences that you submitted but they won't look at all and they will send you an Rfe asking bonafide marriage evidences and you won't have time to have these copies in 87 days. File the form that I said asap if you need the copies you sumited before.
