myssmd yes you can file form I-485 and I-765 now if you want,but keep in mind if Vawa Unit deny your form I-360 they are not deporting now, but if you submit form I-485 and your form I-360 is denied they will start removing proceedings against you.If you have a strong case and you think they will approve then file form I-485,I-765 and I-912. Explain using form I-912 how much you need to survive, to pay rent,food,basic needs, commute etc, and tell that you need to work in order to provide for yourself. If you are receiving some family or friend's financial support then mention that you are grateful for all financial support received, but they cannot help you financially anymore.

Write down in the form I-912 " I do not receive any public benefits. I do not have any savings or any real estate.I was victim of domestic violence. I need to work and I am attempting to start a new life free of violence. I ask USCIS to consider my petition by granting me a fee waiver for the filing of forms I-485 and I-765".

You have to pay to have the medical exams done ok, don't forget to send the medical exams along with your other forms. The form to ask to waive the fee is form I-912 ok

jesse007 yes call them again, leave a brief message saying that you do not have a case number yet, but you submitted form I-360 on xxxxxx. Usually they ignore phone calls when the alien doesn't leave the case number, because of that you have to explain you did not get a case number yet, but your form was filed more than 40 days ago.

Sandranj thanks so l really appeciate it.so can l use medicals from my previous Aos or l have to take another one?my previous aos was denied because he refused come to the interview after an argument.am in removal now so it doesnt matter if l file the i485.l wish l did that before bcos this year has been the hardest.

Myssmd i didnt know you are in removal proceedings then you cant submit form I-485 and I-.765 now because USCIS have no jurisdiction to adjudicate your case .Your case is with Immigration Court then USCIS cannot adjudicate now ok. Did you have the master hearing? Your lawyer can ask in court in the master hearing day that the Judge approve your I-765 .He can file a motion to close administratively your case and if the immigration agrees the judge will close your case and then you can submit form I-485.I explained very well a few weeks ago here about that. Go back a few pages pages 15 i think i am not sure.I explained how it works work permit for those in removal proceeding.

Sandranj ive been to about 3 master hearings but the judge always postpond till l get a decision for my vawa.my lawyer never told me anything like that.l dont know if he knows what hes doing but according to the recommendations l got,they said he,s good but l dont think he,s making an effort with my case.l will ask him and see if he can do that on my next hearing...thanks

Missymd he has two options:1) to ask the judge to approve your work permit or to close administratively your case in order for you to submit to Uscis your I-485.It's unbelievable that he never asked for your EAD. When will be your next hearing?

missymd the judges usually approve work permit when in removal proceedings. I never saw any case denied. Your lawyer can submit before the Court hearing, but i think is more effective in the Court hearing date . You won't leave the Court with an EAD. Your lawyer must file out with the immigration Court, refiled 485/765 with the Court and then after getting a stamp from the EOIR your lawyer will submit form I-765 to Uscis, and he must submit to Uscis a date stamped copy of the Application for Adjustment of Status (Form I-485) received and accepted by the Executive Office of Immigration Review (EOIR)in order for USCIS to issue the EAD.
