I guess it's time for me to finally post here. I've been following this forum for over a year, and am only now compelled to post to help others like me, who've been through the pain and trauma of domestic abuse.

July 2011 - Applied for VAWA with I-765 and I-485 with fee waivers - receipt date Aug 4, 2011
August 10th 2011 - Received NOA's for all 3, fee waivers accepted
August 26th 2011 - Received EAD
Early July 2012 - Re-applied for EAD based on pending I-485
Mid July 2012 - Received NOA for 2nd EAD
August 1st 2012 - Received EAD
Silence for a few more months
October 26th 2012 - I-360 approval
November 19th '12 - Case transferred
May 2013 - Received interview notice

June 2013 - Interview (approved)

Permanent resident since June 2013

I have a quick question .i have filed my vawa on oct 25,2012

And I have one of my friend who is my witness who have seen that abuse .and he is willing to write me affidavit shown that he has seen me going through with my wife and her cruelty .like I have already filed if I want to send them that letter can I do it or should I wait for them to touch my file or send me rfe.please help !!!!!!!

Sahilkundra, you should have your friend write his affidavit and you should hold on to it. If you're sent an RFE for proof of abuse, then you can send the affidavit. Like sandranj has said many times, don't send unsolicited mail to Vermont for your VAWA case. It may never find it's way into your file if you do. Wait until they ask for it.

Hi Everyone,

So I thought I would write a quick note, introduce myself, seeing as Im now part of the VAWA group.

I married my US citizen wife at the beginning of the year. We filed my adjustment papers in July. In March time she started becoming increasingly emotionally and psychologically abusive, in part due to a heavy addiction to alcohol and drugs. I tried to help her through these problems no matter how many lies I was told. We were married, and my job was to try and fix that problem and try and ignore all the abuse. I had my pending adjustment used against me by my wife almost weekly, with threats to revoke her side of the paperwork. One time she was so drunk and emotionally abusive I threatened to leave the relationship if it didn't stop, to which she just laughed and told me I couldn't leave as I had nowhere else to go, and if I left she would get me deported the next day. About a month ago I started making plans to leave her, but couldn't get very far as my EAD took forever to arrive and I had no access to any other funds. The day after out interview notice came, she changed the locks on our house, cleared out and cancelled all our bank accounts, disconnected my phone, ended the relationship via electronic communication, and left me for dead.

I'm now in the process of trying to figure out my VAWA application to file before our interview date in a couple of weeks.

I don't have any money, so I can't afford any legal help, and legal aid can't help as Im not a permanent resident in the states. Therefore Im forced to file on my own. Im scared and terrified every day, and Im even more terrified I wont get this package in on time. I don't really know how to put the package together, so Im trying to learn as much as I can, get it sorted ASAP, all whilst now applying for jobs with all the free time I have, now that I have my SS number. Im now somehow trying to figure out how to start seeing a therapist/counsellor, so I can start getting the help I desperately need, as well as for my paperwork...somehow without paying for the time being.

Its all a bit of a mess, but Im trying to keep positive, and get through this as quickly and as smoothly as I can.

i received the approval notice AND work permit of the new revised i765 you had advised me to refile...so i am in possession of TWO ead cards now !

they had apparently approved the original one (with the c31 code )

what am i supposed to do now? keep both or return one of them?

Forgot to post my timeline:

August 26th 2011 - Received EAD (never did receive prima facie. I guess they issue the EAD quickly in lieu of prima facie)

Silence for several months

Early July 2012 - Re-applied for EAD based on pending I-485

Mid July 2012 - Received NOA for 2nd EAD

August 1st 2012 - Received EAD (also very quick)

Silence for a few more months

October 26th 2012 - I-360 approval (notice said it was approved on the 22nd)

November 19th '12 - Case transferred

I think there's someone else here with a similar approval and transfer timeline. I don't remember who it is.

There you have it. I did not receive any RFE, and Catholic Charities is my legal advocate.

Here's the information I said I'd give you in your other thread.

I did some quick searches to find resources for domestic violence victims in your state:

- This link has a list of advocates in CA per county: Link 1 - When you call the relevant agency, specifically ask for help for a male victim. If all else fails, go to the nearest women's center or domestic violence center and request for help as a male victim.

- This link has instructions for obtaining monetary assistance through California's Victim Compensation Program: Link 2 Your filing a restraining/protective order is one of the necessary steps to show that you are complying with law enforcement concerning your case.

- This link should prvide some reading material as it is specific to men in abusive environments: Link 3 From that link, I found this link to California Men's Centers: California Men's Centers They advertise an online support group for male victims of domestic violence, among other things.

I can't personally vouch for the veracity or effectiveness of the places I directed you to, but I think they are good places to start.

Worst case, call the National Domestic Violence hotline at 1-800-799-SAFE (1-800-799-7233)

EDIT: Found another link for California through the National Domestic Violence Hotline resource page: http://www.cpedv.org/ - Seems the most legit, and their front page shows they provide help in finding help for shelter, legal, and immigration issues.

Somone you dont have to send It the previous form to Uscis just keep it in a safe place and if it's valid in your interview just hand the EAD to the immigration officer.

dewave2 you can get help from pro bono lawyers, but please ask if the lawyer is specialized in Vawa cases, ask how many Vawa cases he/she handled in the last 5 years. Do not submit your Vawa case if you don't have a police certificate ,a psychological evaluation. If you don't have an AOS interview set up yet then you can wait to send your Vawa case to Uscis until you have your psychological evaluation done. Make sure you changed your address with USCIS filing out form AR11 online, wait 10 days and call 1800 number and make sure they updated your address, in most of the cases they didn't update yet and you have to call 2,3 times,but you have to change online first.

If you can't find any lawyer to represent you, if you want send me your own affidavit and I review for you. Keep in mind I won't represent you, but I will review your affidavit and documents and tell you if there are documents missing in your case ok. I don't know if you have a vawa case. I need to know first about your story. I am not saying is your case,but many people were married with men/women suffering substance dependence and they were mean, selfish,but it doesn't mean because some people have an addiction they are abusers. You have to prove you suffered EXTREME MENTAL ABUSE. You have to prove you changed the person you are right now due the abuse suffered, show them you are suffering from depression or anxiety or having or had panic attacks etc...

I reviewed hundreds of mental abuse cases and most of them were not considered extreme mental abuse,they were married with the wrong person, mean person, selfish husband, but the dynamic of the relationship did not show mental abuse. You need to prove you were subjected to control,humiliation,degradation,jealousy etc. All mental abuse cases I handled Uscis approved,but I considered their cases extreme before sending to Vawa Unit.I handled cases of mental abuse where the husband used to go out and tell the wife he had a date in that night with other woman,showed her pictures of some girls he was dating, other case they were married 8 years, 2 children, she never went to the market, never had an appointment with a doctor or dentist, she could not use the land phone or internet, she wasn't even allowed to go outside the house to get her mail, other girl tried to kill herself to escape the abuse, of course each case is unique but USCIS just approve EXTREME MENTAL ABUSE.
