So why for VAWA case, USCIS does not need to interview the US Citizens for their side of stories but based solely on the "victim of abuse" side only?

To be fair, USCIS should interview all parties involved, right? Approve VAWA case if genuine and punish the guilty US spouse.

The pastor did not know verysadguy for his side of story when he wrote the affidavit for his ex. So I guess the pastor's affidavit is only one-sided too.

You can get your senator / congressman ...etc to write affidavits for you too if you like.. but how close to the truth do these outsider know?

I think verysadguy is not an abusive person, otherwise the judge would not award his baby daughter full custody to him, which is unusual for father.Courts tends to favor mothers if there is a young child involved.

How many times have you seen in this forum, when the immigrant spouses fake domestic violence against their US Citizen spouses, so that they could file VAWA case? I have seen plenty since I join here.

The court grant custody on many different basis and a very important one is stability. Very sad guy is established and has astanle home and go he knows what he told the judge. Vawa is not one sided because they require evidence of the abuse. If the is mountainous evidence why call some that is more than likely going to lie. When they passed the act they knew what they were passing. Abuser never admit yo an abuse and if they do the try to rationalize it. They had evidence that she was abuse, bona fide marriage, commune residence and what ever else evidence she produce. Immigration is no fool so let's not fool our selves. Abuse is abuse some people threshold is higher than others hence one instance of abuse may terminate a relationship while in others it takes death to end. I WS informed by a cop that they have respond to several residence where the abuser killed his victim and he tried to rationalize his action. U can't speak for him "is not an abuser" u don't know his ex side of the story. Some spouse like yo use the "alien" spouse immigration status as sabatage

Everyone is forgetting victims,abusers,IOs all have flaws. We are all human beings. No man is perfect except God. FYI, just because someone is a "Pastor" doesn't make him/her perfect. Infact I get very wary of people that labelled "Pastors/Preachers" because some think that the title is the ultimate and has a form of entitlement. Only the Almighty alone knows who is a true worshiper.

If someone didn't blatantly say that its fraud then u are judging them every heart knows its bitterness. Why didn't he petition for her? They were married he brought her here! No he wants to play big and embarrass her or try to control her immigration is fully aware of people like that. Especially if she came on a k visa like in her case. Could she use the approved VAWA case against Verysadguy to challenge the custody of their daughter in court, saying that the daughter would not be safe with an abusive violent father?

Oh she can try, but i doubt she will succeed. The same way a divorce decree based in domestic violence is not ground to have a Vawa approved, a Vawa approval won't have any impact in the child custody.

Good luck with your thread versadguy as all has mentioned before you have the most precious gift of all the chance to live and raise the daughter you both share and no matter what you say GOD HAS THE FINAL SAY and I pray when your daughter grows of age she will be able to discern the truth where you and your exwife are concerned. Indeed this is a very sad situation but as an old trini addage goes 'a woman NEVER leaves a good man' so something had to be amiss somewhere. Dont let your jealousy and hurt and pain cause further damage because in the end the only person who is truly affected is the child. Seek help talk to someone if you need too find closure and move on with your life think of your daughter and whats best for her. Your not perfect either none of us are just move on move on.

I filed concurrently.Not on probation, my case was approved april 26th. Took 13 months... I believe ill get word soon on I485

VSC will transfer the case to your local office. The amount of time it'll take for them to get you in for the interview will depend on how busy they are. You can usually gauge this from the size of your city and the predominant mix of people.
