Having a child together is not proof of a bona fide marriage, it simply indicates that at some point the woman had unprotected sex.

Raising a child together (school records, affidavits from teachers / administrators) can be proof of a bona fide marriage.

That much is true.. but surely a good Vawa case, or rather legit vawa cases can be smelled from a distance. I was never worried about approval. I had the cervical spine surgery to prove.Married 2006 surgery 2009, never filed i130 until 2011 thinking it will work and he would change... Got approved i130 , when I couldnt take it i filed vawa 2012. and that was very hard to do.. Thank God im out..

godisgreat23 the GC is permanent(valid for 10 years) and you just to apply to renew when expire, but you can file for naturalization in 2.9months after the time you got your green card .

Verysadguy she will get the green card and you got full custody of your daughter! . Do I have to say who is the winner here? she is the only loser here. You will have your entire life to be by your child's side, that's what matters.A child is a gift of the LORD and you were blessed with yours.

I won't enter in details, but unfortunately she fooled the USCIS system, but thank God she wasn't capable to fool the Judge who granted him custody of his child.

Since the ex gets the green card based on VAWA, wouldn't that turn against Verysadguy, showing that he indeed an abusive person even he is not???

Could she use the approved VAWA case against Verysadguy to challenge the custody of their daughter in court, saying that the daughter would not be safe with an abusive violent father?

Scammers could go to great length to prove "bona fide marriage", including having a baby (an US Citizen anchor baby)

You need more than a baby in common to prove a real relationship / marriage.

Just like some people thought that having a USC baby or being pregnant will make USCIS process their petitions / visas faster.

If your married that's an "anchor" it self. Ppl get approval based off only marriage so why would she gave a baby with someone she can still get immigration benefits from without a baby. They were clearly in a happy place at one point. They were married and that says a lot, when u have a child born in wedlock. There is 3 sides to a story, her side, his side and the truth. Ppl like to cry for scam when things don't go their selfish way. A pastor affidavit is seen as respectful and truthful and if a pastor buy any means felt any doubt or though for a second she was lying he wouldn't write it. He has a moral responsibility to uphold.

Their was a basis for approval! The io didn't rake up her file and say "u know what she's a scammer let me approve her". She had all the criteria for the approval and she was clearly abuse "her husband calling her an alien" on public forum. Now that's RUDE! Io can smell scam from a distance let alone right under his nose. Sad guy pls go turn that frown around and the fact that u hunt down to find out when she was approved find out how u can have an amicable relationship for the baby.

So why for VAWA case, USCIS does not need to interview the US Citizens for their side of stories but based solely on the "victim of abuse" side only?

To be fair, USCIS should interview all parties involved, right? Approve VAWA case if genuine and punish the guilty US spouse.

The pastor did not know verysadguy for his side of story when he wrote the affidavit for his ex. So I guess the pastor's affidavit is only one-sided too.

You can get your senator / congressman ...etc to write affidavits for you too if you like.. but how close to the truth do these outsider know?

I think verysadguy is not an abusive person, otherwise the judge would not award his baby daughter full custody to him, which is unusual for father.Courts tends to favor mothers if there is a young child involved.

How many times have you seen in this forum, when the immigrant spouses fake domestic violence against their US Citizen spouses, so that they could file VAWA case? I have seen plenty since I join here.

Obviously, this system has its flaws.
