Sandra my friend already moved with his sister and that same day she went the Court of children and adolescents and ask to take that custody of their two children. Now she would like to know how the judge shall decide on the custody case

The House where they live with her sister is big and children have their own room they have food stamps and Medicaid she will continue with their therapies and she will go back to group suppor classes in the shellter for domestic violence and also children star to take therapy

Today she is looking in her area school for the children to attend summer classes she wants to know if all this that she is doing help it and if her case vawa based on violence have domestic psychological can help when the judge determdinar the custod of her children!

Good morning everyone.

Just a quik update , my case still at the same place, no news .

I sent a request to Ombudsman’s Office and they reply saying " We have received the consent and added to your file. This information will be forwarded to the analyst assigned to your case"

but that was a week ago. nothing new after that. I m on my 5th prima facie and it will expire soon. So i guess i will have to apply for my 6th one.

Hope something come my way soon.

Iank if you have a pro bono lawyer ask him to file out form I-765 for you,if you don' have a lawyer you can submit the form. They just submitted form I-912 along with form I-765 and mentioned in the form I-912 they couldn't afford to pay any bills, and they didn' have any family, revenue or assets in the United States.

I can't promise you if it will work for you, but 2 girls that submitted got their EAD and they did not have I-485 pending,one of them received in 3 weeks and the another one in less than 15 days.

So Sandra it did work for them like me! Maybe its a new policy with USCIS because us victims need to work in order to sustain ourselves and our children. God is still in the mkracle working business.

Good morning to all Sandra an us chosen folk those who got their approvals and folks like me waiting.....We are one day closer. Job in the scripture lost all he had and God restored him twice fold let us all keep faith for our blessings. He wont give us more than we can bear.

Ok guys so I sent in my medical records after the RFE that my local office asked for. And now it's saying that they received them but that the case is being processed at the National Benefits Center.?? Anyone have any idea of why it's not at my local office anymore?

cielo14 the judge decides the custody considering the child's well-being,he/she will consider safety and permanency planning, emotional ties and relationships between the child and the mother, capacity of the mother to provide a safe home, food, clothing, and medical care and the the presence of domestic violence in the home. There are a few States (Virginia, Delaware, Kentucky, Michigan, North Dakota, Oregon, Tennessee, Texas, Illinois, Maine, Maryland, Michigan, Oregon, Vermont that recognize domestic violence as a reason to leave the house and file for custody of the children.

She should right away find a doctors for her children, she should take the kids to see a doctor if they need to see one, if they need therapy place them right away to attend therapy sessions, enroll them for summer camp program asap,enroll them to attend school.She will be fine.I am glad she took a few steps already taking care of her children.You are a good friend trying to help her out with informations, she is very lucky to have a friend like you.

cc1988 since May 2012 Vermont is submitting I-485 for Vawa cases to the National Benefits Center (NBC), and NBC checks the file to ensure that the adjustment applications are complete before sending them to the individual District Offices where they are manually scheduled for interview.Probably you had a pending AOS right? then the local office realized you needed a new medical exam and they sent you an RFE, but following new UScis protocol, as I said before, they sent it to NBC and NBC will make sure everything is ok and they will ship back to do local office again.

A small update on my case. I went to the info pass appointment today and they told me that my case was assigned to an officer on May 29, at 7.29 am. So it looks like I'm very close to see the result. Very anxious...
