howtosurvive thanks for the rector street.She will arrive in Nj in a few days.I have to find a shelter for her to say. She is suicidal as I said before.I am trying my best to help her out.Thank you.

anajnic thanks my dear.Her daughter is autistic and she needs constant treatment and this woman needs medical attention as soon I get her here.It's a shame that in Island where she lives there is just one shelter and it's not available to take her and her child. I am trying to find one here.I will pick her up at the airport and take her straight to any shelter for victims of domestic violence.I handled thousands of Vawa,met thousands of women but I never met someone with severe depression like she is right now

Im going to get another place for you tomorrow. Hopefully they say yes especially with the autistic child, I dont think that shelter will be good considering the child. I will make it my business to get to the other place and get you the info in your inbox for security reasons ( domestic violence reasons) God is faithful.Good night and May God keep her until you guys meet

August 10th 2011 - Received NOA's for all 3, fee waivers accepted
August 26th 2011 - Received EAD
Early July 2012 - Re-applied for EAD based on pending I-485
Mid July 2012 - Received NOA for 2nd EAD
August 1st 2012 - Received EAD
Silence for a few more months
October 26th 2012 - I-360 approval
November 19th '12 - Case transferred
May 2013 - Received interview notice

June 2013 - Interview (approved)

Permanent resident since June 2013

Hi

I have a few questions regarding sending the application:

I have 3 children over 16 which are deriviates on my GC, do I need to make a separate vawa application for each, or are they all included in my application?

and is there a fee for each child? is there a way to waiver the fees at all?

about the police clearance: also do I need for each child?

Need hope as far i understood you have a green card,is that right? If yes then you won't file Vawa(I-360) but you will apply to get permanent green card and as a victim of domestic violence you must file I-751 waiver based in extreme cruelty. Your children unmarried under 21 years of age should be included as a derivative beneficiaries. Police clearance is required for derivative beneficiaries over 16 years of age. If you submitted form I-485 and your case is still pending then you have to file form I-360 and you can include your children as a derivative beneficiary as well and children over 16 years of age need police clearance from their home Country and USA

Neehope if your children are under 21 years old and received their green card in the same time you received then you just need to put their names as a derivative beneficiaries and you have to submit police clearance of each one of your child if they are over 16 years of age(Usa police clearance and from your home Country as well(

Neehope do you have police report and restraining order against your husband? If not then it's better you file the I-751 waiver based in bonafide marriage but you must be divorced to file the waiver.You do not need the divorce decree based in extreme abuse.

needhope you have to file FORM I-751, choose the option ":waiver request filing" if you will fill out based in abuse then put x in the option "1e". If you can' t pay Uscis fees then file form I-912 ok.Do not forget to write down a nice affidavit minimum 5 pages maximum 9 pages, telling when and how you met him,describe courtship, describe life after getting marriage and about the abuse suffered as well. Do not forget to send copy of your green card (both sides) and your children's green card copies as well.Submit documents showing commingling finances(joint tax return,statement of joint bank account, copy of credit cart statement etc) and proof of commune residence such as driver license showing same address, lease agreement, utilities bills in name of both and copy of restraining order and police report,if you suffered mental abuse submit a psychological evaluation as well, police clearance and affidavit from friends stating your marriage was genuine; if someone knows about the abuse get an affidavit saying about it as well. if you decide to file just based in bonafide marriage then you have to submit copy if the divorce decree.I am using my phone and probably I misspelled some words...my bad,lol

I have a question please.

I filed for VAWA in May 2012.

In my case, I went through an emotional and sexual abuse. (which is hard to prove).

I have a child from the relationship. I went through extreme abuse during my pregnancy and depression.

My lawyer does a great job, I think. And I just received a RFE for having lived together and demonstrate abuse.

But here is where I get worried. My lawyer has sent a "challenge" for a supervisor to rescind the RFE and explained why I already submitted enough proof.

We are awaiting the results of that challenge.

Have you ever heard of such a move? I trust my lawyer a lot, but I can't help be extremely worried.

Can you please tell me what you think.
