howtosurvive in Virginia she should file for custody. Keep in mind family Law differs from State to State. I checked Virginal Law regarding custody before giving her the information. If she cannot afford the Court fees she should file form DC-606.I am not a lawyer specialized in family Law, but the information I found i got from Virginia Court web site and reading Virginal(family)Law, but maybe I am wrong.

Sandra so she need to go to the Police Department of the city where she is currently or got to the police Department when she and her children are back in the city where they lived before. When they move to her sister house .The same day that they move she need go to the police Department for get a restraining order and an emergency custody of the children.

Cielo14 in Virginia to get a restraining order she has to go to the Court Service Unit of a Juvenile and Domestic Relations Court,not to the police.In Virginia protective order is a civil court order ok. Tell her to write down her City and add " xxxxx and Juvenile and Domestic Relations District Court "and she will be able to find out the address ok.

cielllo14 your friend can get the restraining order where she will live, but of course she needs to be living in her sister"s house when she goes to the Court or when the abuser lives,it doesn't matter ok.

howtosurvive she filed Vawa already and she has prima facie. She is from Us Virgin Island ( insular area of the United States), because of that she is able to enter her without any problem.I live in New jersey and the social services in this area used to give food stamps but lately 2 girls contacted me, they live in NJ ,and they were not able to get food stamp,because of that I want to make sure what City around is giving or not.

I thought all vigin islanders were USC. I learn something new. Tell her to go to rector street. I hope she font want Medicaid because the supervisor up there is very mean.

Hey guys it's been awhile since I have been in the forum. I see lots of new "faces" welcome to forum. Sandranj you are still being the great person you are helping as much as you can keep up the excellent work, I benefited greatly finally sent in package for work permit and green card. For those waiting on approvals it's coming soon I know what the wait it like but hang in there God is great he does wonders.

howtosurvive Criminal Law differs from State to State as well,as it differs in Family Law. You are giving your opinion according with New Jersey Law,but Cielo14 inquired about restraining order in Virginia.Here is what the Virginia Law States about restraining order:

"To ask (petition) for a PPO, go to the Intake Office for the Juvenile and Domestic Relations Court in the locality in which the abuse occurred. A judge will decide if the Preliminary Protective Order will be granted, based on your sworn statement".

"A PPO may: (1) legally order the abuser to stop abusive or threatening behavior; (2) prohibit the abuser from contacting you at home, at work, or by phone; (3) order the abusive person removed from the home you share with him or her; (4) grant exclusive possession, but not title, of the home and/or jointly owned car to you; (5) grant temporary custody and visitation of the children; and/or (6) provide other relief necessary for your protection".
